A Resolution of the City Council of the City of Georgetown, Texas,
Authorizing the Mayor to Execute an Agreement Regarding the
Establishment of the Agreed Extraterritorial Jurisdiction Property
Boundary between the City of Hutto, Texas and the City of Georgetown,
Texas
WHEREAS, the City of Hutto, Texas anc. the City of Georgetown, Texas wisq to estab
Extraterritorial Jurisdiction (ETJ) property boundy between the two municipalities, anc
WHEREAS, pursuant to Section 42.023 of the Texas Local Government Code the cities of
Georgetown anc Hutto have agrees, upon the release of properties from the City of
Georgetown's ETJ to the City of Hutto and to relincuish it's ETJ rights to such releasea
property; anc
WHEREAS, the City of Georgetown, Texas, wishes to enter into an Agreement regarding
Extraterritorial Jurisdiction property boundary by and between the City of Hutto, Texas and
the City of Georgetown, Texas, to establish said ETJ boundary.
Now Therefore, be it Resolved by the City Council of the City of Georgetown, Texas:
That the saic Agreement, being proper and according to law, shall be, anc. it is hereby,
granted; and, further, the Ma\ of is hey eby autzorizec anc directed to execute on behalf of the
Cite said Agreement, a copy of same being attached hereto as Exhibit A and incorporates
herein for all purposes.

AGREEMENT REGARDING
EXTRATERRITORIAL JURISDICTION BOUNDARY BETWEEN THE
CITY OF GEORGETOWN AND THE CITY OF HUTTO
THE STATE OF TEXAS
COUNTY OF WILLIAMSON
KNOW ALL BY THESE PRESENTS
That this Agreement Regardinc the Extraterritorial Jurisdiction Boundary ("Agreement"), made
to be effective as of January 1, 2008, is by and between the City of Georgetown, Texas
("Georgetown"), a home -rule municipality located in Williamson County; Texas and the City Hutto,
Texas ('Hutto"), a home -rule municipality located in Williamson County, Texas.
WHEREAS. Hutto and Georgetown, Texas wish to establish an Extraterritorial Jurisdiction
(ETJ) property boundaries between the two municipalities, and
WHEREAS, Section 42.021 of the Texas Local Government Code establishes the extent of the
statutory ETJ based on .population of municipalities; and
WHEREAS, Section 42.023 of the Texas Local Government Code allows municipalities to
reduce the size of their Extraterritorial Jurisdiction (ETJ) and relinquish all ETJ rights in said property by
o rdinance or resolution: and
WHEREAS, it is expedient and in the best interests of Hutto and Georgetown to reach an
agreement pertaining to a boundary line between them for the purposes of determining the extent of
e ach city's ETJ both now and in the future; and
NOW, THEREFORE, in consideration of the mutual covenants and agreements hereafter
set forth, the receipt and sufficiency of which is hereby acknowledged, the Parties hereby agree
as follows:
That the City of Georgetown hereby agrees that all of the real property lying generally south
and east of the Beginning Point and End Point of the boundary line as shown on Exhibit 'A" and
described in Exhibit "B", attached hereto and made part herof for all intents and purposes, shall belong
with the Extraterritorial Jurisdiction ("ETJ°) of the City of Hutto. By so doing, the City of Georgetown
hereby relinquishes all Extraterritorial Jurisdiction rights to the City of Hutto which it has or may
hereinafter acquire in said property.
That the City of Hutto hereby agrees to accept such above -described real property into its
e xtraterritorial jurisdiction (ETJ) now or some time in the future.

That the City of Hutto hereby agrees that all of the real property lying generally north and west

IV.
That the City of Georgetown hereby agrees to accept such above -described real property into
its extraterritorial jurisdiction (ETJ) now or some time in the future.
V
That the City of Georgetown hereby agrees that the effect of this agreement is to reduce or
expand the future extraterritorial jurisdiction of the City of Georgetown. Further; the governing body of
the City of Georgetown has given it required written consent by Resolution No.
in accordance with V.T.C.S., Local Government Code, §42.023.
VI.
That the City of Hutto hereby agrees that the effect of this agreement is to reduce or expand
the future extraterritorial jurisdiction of the City of Hutto. Further; the governing body of the City of
Georgetown has given it required written consent by Resolution No. in
accordance with V.T.C.S., Local Government Code, §42.023.
VII.
That both parties hereby agree that this agreement is privy only between the parties herein and
in no way affects; gains, or gives up any right or interest which may now or hereafter exist between the
parties herein and any municipality nota party to this agreement.
VIII
That this agreement shall become binding January 1, 2008 upon the proper execution
thereof by the City of Hutto and the City of Georgetown.
