A Resolution of the City Council of the City of Georgetown, Texas, Authorizing the Mayor to Execute an Agreement Releasing Extraterritorial Jurisdiction Property by and between the City of Hutto, Texas and the City of Georgetown, Texas. WHEREAS, the City of Georgetown, Texas, wishes to release certain real property from its Extraterritorial Jurisdiction (ETJ), and relinquish all ETJ rights in sail property to the City of Hutto, Texas, anc WHEREAS, Section 42.021 of the Texas Local Government Code establishes the extent of Extraterritorial Jurisdiction of municialities; anc WHEREAS, Section 42 023 of the Texas Local Govern lent Code allows municipalities to reduce the size of their Extraterritorial Jurisdiction (ETJ) an a relinquish all ETJ rights in said property by orcinance or resolution; and tAIHERFAS, the City of Georgetown, Texas, wishes to enter into an Agreement Releasing anc. Accepting Extraterritorial Jurisdiction Property by anc between the City of Hutto, Texas anc. the City of Georgetown, Texas. Now Therefore, be it Resolved by the City Council of the City of Georgetown, Texas: that the said Agreement, being proper and according to law, shall be, and it is -tereby granted anc, further, the Mayor is hereby authorized ana directec to execute on behalf of the City said Agreement, a cony of same being attached hereto as Exhibit A anc incorporates herein for all Jurposes. C.arls, City Attorney i a Resolution Exi n m �eirrr.'ror1al Jurisdiction Release and Acceptance: CTh ofHutto Gary ion, Mayor Page I of 12.05/2007 AGREEMENT RELEASING AND ACCEPTING EXTRATERRITORIAL JURISDICTION BOUNDARY BETWEEN THE CITY OF GEORGETOWN AND THE CITY OF HUTTO THE STATE OF TEXAS COUNTY OF WILLIAMSON KNOW ALL BY THESE PRESENTS That this Agreement Releasing and Accepting Extraterritorial Jurisdiction Property ("Agreement"), made to be effective as of January 1; 2008; is by and between the City of Georgetown, Texas ("Georgetown'), a home -rule municipality located in Williamson County, Texas and the City Hutto, Texas ("Hutto"), a home -rule municipality located in Williamson County, Texas. WHEREAS, Hutto and Georgetown; Texas wish to establish an Extraterritorial Jurisdiction (ETJ) property boundaries between the two municipalities, and WHEREAS, Section 42.023 of the Texas Local Government Code allows municipalities to the size of their ETJ's by ordinance or resolution; and the parties have done so by separate action and agreement; and WHEREAS, it is expedient and in the best interests of Hutto and Georgetown to reach an agreement pertaining to a boundary line between them for the purposes of determining the extent of e ach city's ETJ both now and in the future and NOW, THEREFORE, in consideration of the mutual covenants and agreements hereafter set forth, the receipt and sufficiency of which is hereby acknowledged, the Parties hereby agree as follows: That the City of Georgetown hereby agrees to release certain real property from its e xtraterritorial jurisdiction (ETJ), said property being as shown on Exhibit 'A" and described on Exhibit "B" attached hereto and made part hereof and incorporated herein By so doing, the City of Georgetown hereby relinquishes all extraterritorial jurisdiction rights to the City of Hutto which is has or may acquire in said property. That the City of Hutto hereby agrees to accept such above -described real property into its extraterritorial jurisdiction (ETJ) now or some time in the future. That the City of Georgetown hereby agrees that the effect of this agreement is to reduce the e xtraterritorial Iurisdiction of the City of Georgetown. Further, the governing body of the City of Georgetown has given it required written consent by Resolution No. l 0 -m ESL. in accordance with V.T. C.S., Local Government Code; §42.023. That both parties hereby agree that this agreement is privy only between the parties herein and in no way affects, gains, or gives up any right or interest which may now or hereafter exist between the parties herein and any municipality not a party to this agreement.
