HomeMy WebLinkAboutRES 092507-BB - Not Exempt Goods in TransitES©LUT I OM SJOe Q4ao 07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, EXPRESSING OFFICIAL TO NOT EXEMPT GOODS IN TRANSIT FROM PROPERTY TAX AS ALLOWED UNDER STATE LAW. WHEREAS, pursuant to the Texas Constitution and TEx. PROP. Tax CODE, § 11.253, local taxing units are granted the option to tax goods in transit which would otherwise be exempt pursuant to § 11.253; and WHEREAS, this governing body has held a public hearing pursuant to TEX. CONST. Art. ✓ III, § 1-n(d) on the issue of whether goods in transit, as defined by the referenced § 11.253, should be taxed or exempted; and WHEREAS, the Georgetown City Council determines that it is in the public interest to provide for the ad valorem taxation of goods in transit, as defined by the referenced § 11.253 N OW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: S ECTION 1. All "goods in transit" as defined by TEX. PROP. TAX CODE § 11.253 shall be subject to ad valorem taxation by the City, pursuant to the annual ad valorem tax assessment, if not otherwise exempt or subject to abatement by law other than § 11.253 and TEX. CONST. Art. VIII, § 1-n. S ECTION2. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policy of the Century Plan - Policy Plan Element: 1. Finance Policy Statement 13.0, which states: "Ail municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided", and further finds that the enactment of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. S ECTION 3. The Mayor is hereby authorized to sign this resolution and the City Secretary to attest. This resolution shall be effective immediately upon adoption.
