OW v 07� 1.- A RESOLUTION AMENDING RESOLUTION NO. 052207-K TO RE - CANVASS THE RETURNS OF THE RACE FOR COUNCILMEMBER FOR DISTRICT 4, AND DECLARE OFFICIAL THE RESULTS OF THE CITY OF GEORGETOWN GENERAL ELECTION HELD ON MAY 12, 2007 WHEREAS, on May 22, 2007, the City Council of the City of Georgetown canvassed the results of the May 12, 2007 General Election to elect Councilmembers from City of Georgetown Single -Member Districts 3, 4 and 7; and WHEREAS, the City Secretary was notified, on May 31, 2007, by the Williamson County Elections Administrator that one ballot was mailed from overseas to be included in the vote count from Precinct 381 for Councilmember for District 4; and that ballot has now been added to the original ballot count for Precinct 381 that was distributed by the Williamson County Elections Office on May 15, 2007 at 4:21 p.m., making the final results of the Election different for District 4 by one vote, and WHEREAS, it appears from said return that the final ballot count from Precinct 381 for the unopposed candidate in the District 4 Councilmember race was 2,820; and therefore, the total votes for Bill Sattler were 2,883 instead of 2,882. The vote totals for the candidates from District 3 and District 7 remain the same as in the previous resolution, those votes being: District 3 District 7 Dale Efflandt 48 Ben Oliver Keith Brainard 276 Chris Damon 263 186 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION I. The City Council officially finds and determines that the Election was duly called; that proper notice of the Election was given in accordance with law; that the Election was held in accordance with law; that a revised return of the results of the Election has been made by the party contracted to conduct the Election, and that the City Council has re -canvassed the returns, all in accordance with the law and the resolution calling the Election. SECTION II. It appears from said returns, duly and legally made, that Keith Brainard was duly elected as Councilmember for City Single -Member District 3, and Bill Sattler was duly elected as Resolution No ©iP 42 ©7 &ea 1— Re-canvass of May 12, 2007 General Election Page 1 of 2 Pages Councilmember for City Single -Member District 4, and Ben Oliver was duly elected as Councilmember for City Single -Member District 7. SECTION III. It is further found and determined that in accordance with the order of this governing body the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall, a place convenient and readily accessible to the general public, and said notice was posted and remained posted continuously for at least 72 hours preceding the scheduled time of the meeting A copy of the posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. SECTION IV All Resolutions or parts of Resolutions that are in conflict with this Resolution are hereby repealed, and no longer in effect. If any provisions of this Resolution or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Resolution which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are hereby declared to be severable. SECTION V. The Mayor of Georgetown is hereby authorized to sign this Resolution and the City Secretary to attest.
