HomeMy WebLinkAboutMinutes_ZBA_04.16.1996MINUTES City of Georgetown BOARD OF ADJUSTMENT MEETING April 16, 1996 7:00 p.m. City Hall Council Chambers, 101 E. 7th Street Georgetown, Texas The meeting was called to order at 7:03 p.m. by Rex Peebles. Other Board members in attendance were Roy Headrick, Claude Proctor, Cal Wilkerson and Linda Vaclavik. Staff present were, Charles Simon, Senior Planner Wendy Walsh, Senior Planner, Tammie D. Warfield, Janis Russell, Recording Secretraies. 1.Consideration of and possible action on a request for a variance to the Zoning Ordinance for Lot 1, Industrial Park North, located at 40100 Industrial Park Circle. Wendy Walsh gave the staff report. John Warden, the agent for the applicant, was present and responded to the Board's questions. After the discussion, Linda Vaclavik made a motion to approve the variance based on the following findings: - It will not be contrary to the public interest, because the property is zoned Industrial, precedence is set for an eight (8) foot fence in this type of situation, and the fence will not impair vision from Industrial Park Circle, it offers no direct contradiction to the adopted Zoning Ordenance. - A strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being the possibility of theft and safety concerns without an eight (8) foot fence. - The spirit of this ordinance shall be observed and substantial justice done subject to the following limitations that this variance shall be limited to the propsed use only. Claude Proctor seconded the motion which passed by a vote of 5-0. 2. Consideration of and possible action on a request for a variance to the Zoning Ordinance for Glasscock Second Addition, Block 30, Lot 2, a resubdivision of Lots 3 and 4, located at 414 East 7th Street. Charles Simon gave the staff report. Roger L. Taylor, the applicant, was present and responded to the Board's questions. After the discussion, Linda Vaclavik made a motion to approve the variance based on the following findings: -It will not be contrary to the public interest, because there are no site obstructions, there are excessive street widths, the City has received only positive comments from neighbors, and it offers no direct contradiction to the adopted Zoning Ordinance. -A strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being there is not easy access due to drainage and that the existing on-street parking is dangerous. - The spirit of this ordinance shall be observed and substantial justice done subject to the following limitations that this variance shall be limited to the propsed use only. Roy Headrick seconded the motion which passed by a vote of 5-0. 3. Consideration of and possible action on a request for a variance to the Zoning Ordinance for Williams Addition, Section One, Block 1, Lots 1 and 2, located at 211 West Central Drive and 1613 Williams Drive. Charles Simon gave the staff report. Jimmy Umstattd, an agent for the applicant, was present and responded to the Board's questions. Polly Brock addressed the Board. Randy Howrey addressed the Board and requested that the case be tabled since there are several changes to the plan that were proposed during the meeting. Roy Headrick made a motion to table the case and Claude Proctor seconded the motion which was passed by a vote of 5-0. Mr. Umstattd was requested to show locations of the fences and buffers and a better map of the property in relation to the location of the trees and buildings. City staff was requested to research the intent of the ordinance regarding the number of parking spaces and seek legal opinion of the RO Zoning. 4. Members reports and comments. None were made. The meeting was adjourned at 8:40 p.m.
