BOARD OF ADJUSTMENT MEETING
August 20, 1996 7:00 p.m.
City Hall Council Chambers, 101 E. 7th Street
Georgetown, Texas
The meeting was called to order at 7:11 p.m. by Rex Peebles.
Other Board members in attendance were Larry Brown, Claude Proctor, Cal Wilkerson and Linda
Vaclavik. Staff present were, Hildy Kingma, Chief Planner of Current Planning, Wendy Walsh, Senior
Planner, Tammie D. Warfield, Recording Secretary, Sheree Rabe, Assistant City Attorney, and
Marianne Banks, City Attorney.
1. Approval of minutes of the June 18, 1996, Board of Adjustment meeting.
Linda Vaclavik made a motion to approve the minutes as written. Claude Proctor seconded the motion
which passed by a vote of 4-0, with Cal Wilkerson not voting because she did not participate in the last
meeting.
2. Consideration of and possible action on a request for a Special Exception for the City of
Georgetown, Block 49, Lot 4, locally known as 810 Rock Street.
Staff presentation was given by Marianne Banks, City Attorney. Marianne Banks advised the Board that
the City's Zoning Ordinance, as written, only pertains to radio and television towers. The Federal
Government passed a telecommunications act in the spring of 1996 and at this time the City's Zoning
Ordinance does not incorporate language specific to telecommunication towers. Marianne Banks does
not believe that the Ordinance, as written, allows the Board to take any kind of action requested on this
application. The Board was also advised that they could not act on this case if the provisions are not in the
ordinance. Marianne Banks then responded to questions from Board members in reference to the
legalities of their positions. Ms. Linda Holmes and Mr. Michael Crane, representatives for AT & T
Wireless, addressed the Board and offered their assistance in this matter. Marianne Banks informed the
Board that she had advised the City Manager to hire a consultant to gather the needed information to
rewrite Section 11.403.8 of the Zoning Ordinance. This is expected to be completed in six (6) weeks. In
addition to the six (6) weeks required to rewrite this section of the Zoning Ordinance, it is also required
that a public hearing and two (2) readings of the proposed ordinance occur before the changes can be
accepted. Therefore, she suggested that the Board table the application until December, 1996.
After the members had a short discussion, Linda Vaclavik motioned to table the application until the
meeting on the 19th of December 1996, due to discrepancies in the City's Zoning Ordinance. Larry
Brown seconded the motion which passed by a vote of 5 - 0.
3. Members reports and comments. None were made.
The meeting was adjourned at 7:28 p.m.
