HomeMy WebLinkAboutMinutes_ZBA_10.15.1996MINUTES City of Georgetown BOARD OF ADJUSTMENT MEETING October 15, 1996 7:00 p.m. City Hall Council Chambers, 101 E. 7th Street Georgetown, Texas The meeting was called to order at 7:02 p.m. by Rex Peebles. Other Board members in attendance and on the dais were Larry Brown, Claude Proctor, Gerald Carson, and Charles Parker. Roy Headrick was present in the audience. Staff present were Hildy Kingma, Chief Planner of Current Planning, and Charles Simon, Senior Planner. 1. Approval of minutes of the September 17, 1996, Board of Adjustment meeting. Claude Proctor made a motion to approve the minutes as written. Charles Parker seconded the motion which passed by a vote of 4-0-1, with Gerald Carson abstaining because he was not present at the September meeting. 2. Consideration of and possible action on a variance to the parking requirements and the area regulations of the Zoning Ordinance for South San Gabriel Urban Renewal, Block K, Lot 20, located at 715 9th Street. Staff presentation was given by Charles Simon. Warren McCracken, the agent for the applicant, addressed the Board. He stated that requiring the subject house to provide two (2) parking spaces would make it unique in the neighborhood because most houses only have one (1) parking space; the two (2) foot side yard setback shown on his conceptual drawing was based on the location of the gate in the fence, but it is not necessary to build the driveway in that location; given the distance between the property boundary and the house, it may not be possible to conform to both the seven (7) foot side setback and the 9.5 foot driveway width requirements; and it is acceptable to the applicant to build a 9.5 foot wide driveway. Speakers present to address this item included 1) Ethel Moore, who asked about the request because she had been told that her house was going to be taken for the construction of a parking lot, and 2) Paulette Taylor, who also thought a parking lot was going to be constructed. Rex Peebles and Hildy Kingma described the request and the requirement for notification of surrounding property owners. Claude Proctor made a motion to approve the requested variances to the parking standards and area regulations of the Zoning Ordinance to address the following issues: 1. Section 2.0203.1.a. - the location of the proposed parking within the front yard setback; 2. Section 7.101 - the number of parking spaces; 3. Table 7 - the width of the proposed parking; and 4. Section 2.0203.1.b. - the proposed side yard setback, as it will not be contrary to the public interest, due to the fact that this variance will make the subject property consistent with the neighborhood and that safety will not be compromised; and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being the additional cost to Habitat for Humanity and the homeowner; and such that the spirit of this ordinance shall be observed and substantial justice done subject to the limitation that the driveway should be built to comply with the seven (7) foot side setback as much as possible. Gerald Carson seconded the motion which passed by a vote of 5 - 0. 3. Members reports and comments. Gerald Carson asked that staff consider a way to require applicants to certify/acknowledge that they know the standards that will be required of them before they begin construction. Hildy Kingma said she would address this issue with the Building Official. The meeting was adjourned at 7:45 p.m.
