Claude Proctor, Vice-Chair, called the May 29, 1997, Board of Adjustment meeting to order at 7:02 p.m. Other Board Members present were Linda Vaclavik, Charles Parker, Gerald Carson and Joe Ogden. Rex Peebles and Larry Brown were absent. Staff present were Hildy Kingma, Chief Development Planner of Current Planning, Wendy Walsh, Development Planner and Carla Benton, Development Technician and acting Recording Secretary. 1. Approval of minutes of the March 18, 1997, Board of Adjustment meeting. Linda Vaclavik made a motion to approve the March 18, 1997, minutes as written. Charles Parker seconded the motion which passed by a vote of 5-0. 2. Consideration of and possible action on a Variance to the Fence Requirements of the Zoning Ordinance for University Park, Section One, Block D, Lot 20, located at 1701 E. 19th Street. Hildy Kingma gave the staff report. Mr. Robert Goodrich, the applicant and property owner was present and provided photos to the Board. Linda Vaclavik made a motion to approve a variance to Section 8.303 of the Zoning Ordinance for the construction of a six (6) foot tall privacy fence along the Hutto Road property line for University Park, Section One, Block D, Lot 20, located at 1701 E. 19th Street as it will not be contrary to the public interest, due to the following special conditions: it does not occlude the line of vision 20 to 45 feet set back from the corner of 19th Street and Hutto Road, and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant by not being able to have a secure "back" yard for children and pets; and such that the spirit of this ordinance shall be observed and substantial justice done provided the applicant secures a License to Encroach into the Public Utility Easement from the City. Gerald Carson seconded the motion which passed by a vote of 5-0. 3. Consideration of and possible action on a Variance to the Side and Rear Yard Setback Requirements of the Zoning Ordinance for Montgomery Addition, Lot 7 and a part of Lot 6, located at 1804 South Main Street. Wendy Walsh gave the staff report. Ms. Georgina Richaud, applicant and property owner, spoke to the Board and responded to its questions. After the discussion, Gerald Carson made a motion to approve a Variance to Section 2.0303.1.b of the Zoning Ordinance for the construction of a garage in the required seven (7) foot side and rear yard setbacks for the Montgomery Addition, Lot 7 and a part of Lot 6, located at 1804 South Main Street, as it will not be contrary to the public interest, due to the following special conditions: replication of the garage located three (3) feet from property line, and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to the applicant being the realignment of driveway access to the house and such that the spirit of this ordinance shall be observed and substantial justice done subject to compliance with the replication process. Linda Vaclavik seconded the motion which passed by a vote of 5-0. 4. Members reports and comments. None were made. The meeting was adjourned at 7:41 by Claude Proctor.
