Rex Peebles, Chair, called the June 17, 1997, Board of Adjustment meeting to order at 7:01 p.m. Other Board Members present were Gerald Carson, Claude Proctor, Charles Parker and Joe Ogden. Linda Vaclavik and Larry Brown were absent. Staff members present were Hildy Kingma, Chief Development Planner of Current Planning, Wendy Walsh, Development Planner, Sheree Rabe, Assistant City Manager and Janis Russell, Recording Secretary. 1. Approval of minutes of the May 29, 1997, Board of Adjustment meeting. Gerald Carson made a motion to approve the minutes as written. Claude Proctor seconded the motion which passed by a vote of 4-0-1 (Rex Peebles abstained due to his absence at that meeting). 2. Consideration of and possible action on Variances to the Setback, Lot Coverage and Yard Requirements of the Zoning Ordinance for Country Club Acres, Block E, Lot 3, located at 1100 Country Club Road. Wendy Walsh gave the staff report. Sid Allen, the applicant addressed the Board. After the discussion, Gerald Carson made a motion to authorize variances to Section 2.0303.1.a, to allow an extension of the original driveway which also accommodates parking in the front yard setback; to 2.0303.1.b.,to allow concrete pads to encroach into the east and west side setbacks, concrete footing to encroach into the west side setback, and a concrete planter to encroach into the rear yard setback; to Section 20303.1.c. to allow the lot coverage to remain approximately 42 percent; and to Sections 2.0303.1.b. and 6.105 of the Zoning Ordinance to allow the original storage building which encroached into the side yard setback to have been reconstructed within the side yard setback, located at 1100 Country Club Road, as it will not be contrary to the public interest, due to the following special condition: there is no adverse impact on nearby home owners, and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being the loss of redress from and no method for handling forces of nature and topography; and such that the spirit of this ordinance shall be observed and substantial justice done subject to the following limitation: the applicant must secure a License to Encroach, which is considered by the Director of the Community Owned Utilities Division, and all other utility providers (telephone, natural gas and television). Joe Ogden seconded the motion which passed by a vote of 5-0. 3. Member's reports and comments. Hildy informed the Board of the drainage workshop on Thursday, July 19th, at 1:00 in large meeting room at the Library. With no further business, the meeting was adjourned at 7:39 p.m. /jmr
