MINUTES
BOARD OF ADJUSTMENT MEETING
SEPTEMBER 16, 1997, 7:00 P.M.
Rex Peebles, Chair, called the September 16, 1997, Board of Adjustment meeting to order at 7:04 p.m.
Other Board Members present were Joe Ogden, Claude Proctor, Charles Parker and Larry Brown.
Linda Vaclavik was absent. Staff members present were Kim Shaw, Development Planner, Tom Bolt,
Building Plan Reviewer and Janis Russell, Recording Secretary.
1. Approval of minutes of the August 19, 1997, Board of Adjustment meeting. Charles Parker
made a motion to approve the minutes as written. Claude Proctor seconded the motion which
passed by a vote of 4-0-1. Larry Brown abstained due to his absence at that meeting.
2. Consideration of and possible action on a Variance to the side yard setback requirements of the
Zoning Ordinance for Country Club Acres Unit 3, Lot 4, Block 3, located at 1606 Gabriel
View Drive. Kim Shaw gave the staff report and responded to the Board's questions. Scott
Alderman, the applicant, was present and addressed the Board. After the discussion, Claude
Proctor made a motion to authorize a Variance to Section 8.202 of the Zoning Ordinance to
allow impervious construction (driveway only) in the side setback on the southern side of 1606
Gabriel View Drive, Country Club Acres, Unit 3, Lot 4, Block 3, as it will not be contrary to
the public interest, due to the following special conditions: the narrow configuration of the lot
and the location of the two (2) trees that limit the routing of the driveway; and because a strict
enforcement of the provisions of the ordinance would result in unnecessary hardship to the
applicant being parking vehicles in front of the house in the absence of an accessible garage;
and such that the spirit of this ordinance shall be observed and substantial justice done.
Charles Parker seconded the motion which passed by a vote of 5-0.
3. Member's reports and comments. None were made.
With no further business, the meeting was adjourned at 7:17 p.m.
