MINUTES
BOARD OF ADJUSTMENT MEETING
March 17, 1998, 7:00 P.M.
Rex Peebles, Chair, called the March 17, 1998, Board of Adjustment meeting to order at 7:06 p.m. Other Board
Members present were Joe Ogden, Claude Proctor, Gerald Carson and Patrick Walsh. Charles Parker was absent. Staff
members present were Hildy Kingma, Chief Development Planner, Kim Shaw, Development Planner, and Janis Russell,
Recording Secretary.
1. a. Introduction of new members - Rex Peebles introduced Patrick Walsh and Sheila Johnson.
b. Election of officers - Gerald Carson nominated Rex Peebles for Chair of the Board. Joe Ogden
seconded the nomination. Rex Peebles was elected by a vote of 4-0-1. Joe Ogden nominated Patrick
Walsh for Vice Chair of the Board. Gerald Carson seconded the motion. Patrick Walsh was elected
by a vote of 4-0-1.
c. Revision to by-laws - Kim Shaw distributed copies of the Board of Adjustment Orientation manual
including By-laws to the members and pointed out a revision that must be made according to State
Statute. Patrick Walsh made a motion to table voting on the revision until the next meeting, to give
the Board time to look over the By-laws and make sure there are no more revisions that need to be
considered. Gerald Carson seconded the motion which passed by a vote of 5-0.
2. Consideration of and possible action on the minutes of the October 21, 1997, Board of Adjustment meeting.
Claude Proctor made a motion to approve the October 21, 1997, Board of Adjustment minutes as written. Joe
Ogden seconded the motion which passed by a vote of 3-0-2, with Gerald Carson and Patrick Walsh abstaining.
3. Consideration of and possible action on a Variance to the requirements for impervious coverage of the Zoning
Ordinance for San Gabriel Heights, Section Five, Block G, Lot 9, located at 601 Friendswood Drive. Kim
Shaw gave the staff report. Discussion followed regarding impervious coverage limits in the Zoning
Ordinance and Subdivision Regulations. Allen Baran, agent for the applicants, was present and concurred
with the staff report. After the discussion, Gerald Carson made a motion to approve a variance to Section
2.0203 C. of the Zoning Ordinance to allow 37 percent lot coverage for San Gabriel Heights, Section Five,
Block G, Lot 9, located at 601 Friendswood as it will not be contrary to the public interest, due to the following
special conditions: the lot is well covered with numerous large trees; the loss of the pervious area will not
impact the environment detrimentally; the variance will permit the current owner to continue unhindered
occupancy; and because a strict enforcement of the provisions of the ordinance would result in unnecessary
hardship to this applicant being the necessity to sell their home, leave friends and purchase an alternate
residence; and such that the spirit of this ordinance shall be observed and substantial justice done subject to the
following limitation: no further tree removal from this property. Patrick Walsh seconded the motion which
passed by a vote of 5-0.
4. Members’ comments and reports. A brief discussion followed regarding the necessity to change the Zoning
Ordinance to be consistent with the Subdivision Regulations.
5. Staff comments and reports.
a. Discussion of Zoning Ordinance revisions - Hildy updated the Board on the progress being made on
the revisions to the Zoning Ordinance.
