Patrick Walsh, Vice-Chair, called the February 16, 1999, Board of Adjustment meeting to order at 7:00 p.m. Other Board Members present were Rhonda Faught, Patti Hershey, Sheila Johnson and Charles Parker. Gerald Carson was absent. Staff members present were Carla Benton, Development Technician, Art Rodriguez, Assistant City Attorney, Wendy Walsh, Development Planner, Tom Bolt, Building Plan Reviewer and Janis Russell, Recording Secretary. 1. Variance to the Zoning Ordinance for Glasscock Addition, Block 31, Lot 8, located at 501 Elm Street. Wendy Walsh gave the staff report. Paul Lefforge, the applicant addressed the Board. After the discussion, Charles Parker made a motion to authorize a variance to Section 6.102 of the Zoning Ordinance to allow a side-entry garage with a future second floor addition for a bedroom, to be constructed ten feet into the side street yard setback, and the existing residence to remain within the side street yard setback on 5th Street, for Glasscock Addition, Block 31, Lot 8, located at 501 Elm Street, based on the following findings: - It will not be contrary to the public interest due to the following special conditions: it will enhance off-street parking and will assist in the renovation of a structure in Old Town; and - because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being the inability to renovate this structure; and - such that the spirit of this ordinance shall be observed and substantial justice done subject to the following limitations: will assure that drainage from this property will not in any way impede the neighbor’s property. Sheila Johnson seconded the motion which passed by a vote of 5-0. 2. Members’ comments and reports. None were made. 3. Staff comments and reports. Art Rodriguez asked that the Board hold an executive session at the next Board meeting. With no further business, the meeting was adjourned at 7:40 p.m. /jmr
