BOARD OF ADJUSTMENT MEETING
MINUTES
October 19, 1999
Patrick Walsh, Vice Chair, called the meeting to order at 7:00 p.m. Other Board members present were Rhonda Faught, Charles Parker, Gerald
Carson and Sheila Johnson. Bill Nahay and Patti Hershey were also present.
Staff members present were Art Rodriguez, Assistant City Attorney, Wendy Walsh, Development Planner, Chris Stewart, Development Planner
and Janis Russell, Recording Secretary
Agenda:
1. Election of Officers. Charles Parker nominated Patrick Walsh as Chair. Gerald Carson seconded the
nomination and Patrick Walsh was elected Chair by a vote of 4-0-1 (Patrick Walsh abstained from
voting). Sheila Johnson nominated Gerald Carson for Vice Chair. Charles Parker seconded the
nomination and Gerald Carson was elected Vice Chair by a vote of 4-0-1 (Gerald Carson abstained from
voting).
2. Minutes of the May 18, 1999 meeting. Charles Parker made a motion to approve the minutes as written.
Gerald Carson seconded the motion which passed by a vote of 5-0.
3. Variance to the Zoning Ordinance for .278 acres in the Morrow Addition, Block 0, located at 1215 S.
Austin Avenue. Chris Stewart gave the staff report. Chip Vacek was present and responded to
questions from the Board. After the discussion, Gerald Carson made a motion to authorize a variance
to Section 2.0203 (1)(b) of the Zoning Ordinance to allow a 6 foot encroachment into the north side yard
setback, and a 2 foot encroachment into the rear yard setback to permit the construction of a 20 foot by
20 foot garage, for 0.278 acres in the Morrow Addition, Block O, located at 1215 South Austin Avenue,
because it will not be contrary to the public interest because it will move the garage within the
applicant’s own property; and because a strict enforcement of the provisions of the ordinance would
result in unnecessary hardship to this applicant because no other location for the garage is feasible; and
such that the spirit of this ordinance shall be observed and substantial justice done subject to the
applicant maximizing the distance to the north side and rear property lines. Charles Parker seconded the
motion which passed by a vote of 5-0.
4. Variance to the Zoning Ordinance for Cody Addition, Block I, 0.14 acres of Lot 13, located at 1221
Church Street. Wendy Walsh gave the staff report. Lamar Boughton was present and responded to
questions from the Board. After the discussion, Gerald Carson made a motion to authorize a variance
to Section 2.0203 (1)(b) of the Zoning Ordinance to allow an 8 foot by 20 foot storage building to be
constructed within the seven foot north side setback, an existing carport to remain within the seven foot
north side setback and an existing metal shed to remain within the south side and rear setback, for Cody
Addition, Block I, 0.14 acres of Lot 13, located at 1221 South Church Street because it will not be
contrary to the public interest; and because a strict enforcement of the provisions of the ordinance would
result in unnecessary hardship to this applicant because it would constrain continued and expanded
enjoyment of his home; and such that the spirit of this ordinance shall be observed and substantial
justice done. Charles Parker seconded the motion which passed by a vote of 5-0.
5. Members’ comments and reports.
Gerald Carson asked staff if temporary storage buildings were treated differently than those that are site built and on foundations.
Wendy Walsh responded that the Zoning Ordinance does not distinguish between site-built structures and those built on
foundations. None are allowed in building setbacks without a variance.

With no further business, the meeting was adjourned at 8:05 p.m.
