CITY OF GEORGETOWN
ZONING BOARD OF ADJUSTMENT MEETING
MINUTES
June 18, 2002
Tom Nichols called the meeting to order at 6:00 p.m. Other Board members present were Thomas
Bennett, Michelle Gambino, Ken Fuller, and Joshua Konkle.
Staff members present were Bobby Ray, Chief Planner/Current Planning, and Tammye Sharpe, Recording
Secretary.

2. Minutes of the March 19, 2002, meeting were considered.
Bennett made the motion to approve minutes as is. Fuller seconded the motion, which passed
with a vote of 4-0.
3. Consideration and possible action on a Public Hearing for a Variance to the Zoning Ordinance
for Lot 1, Block H of Reata Trails, Unit One, located at 3308 Lonesome Trail. Bobby Ray
presented the staff report. Pictures were passed to the Board members.
Pictures were distributed to the Board members that were provided by the applicant. Bobby Ray
gave staff report, and concluded that the variance request was only for the deck, and not to the
pool, as the applicant has a permit for the pool, and that there were two public comments that
were in favor of granting the variance request.
Tim Elliott, applicant, explained that he did not think he needed a permit for the pool (as it was
not required 10 years ago), and when he was cited, he came to the City and requested the
permit. Elliott said that at that time he talked with Tamera Baird, City Permit Technician, who
issues the residential permits. Elliott said Baird informed him that he did not have to stop
construction of his deck as long as he was three feet from the property line with the pool. Elliott
said Baird told him that the City does not look at ADA ramps and deck. Elliott said the reason
they had to build the ramp was because their daughter had gotten too big to carry everywhere.
He also stated that the pool and the deck were not permanent structures. Betty Elliott said the
latticework, the railing, and the gate were put in for safety reasons. Mr. Elliott confirmed that th e
screen was there to shield from sun and for safety reasons with the deck being the height it
was.
Ray said that Baird told him when she spoke with Elliott, she was talking strictly about the ramp,
and was unaware there was a deck.
Board members had concerns about neighbor comments, if there was drainage issues, other
ways to construct deck, height restrictions on improvements, and the screening. Fuller thought
that big trees would be a good idea for a screen on the side yard.
Bennett made the motion to approve variance to:
Sections 5.202 of the Zoning Ordinance to allow encroachment of an existing deck and above
ground swimming pool into the required 10’ street -side yard (allows the deck to encroach 10’
and the swimming pool to encroach 4’), based on the following findings:
- It will not be contrary to the public interest due to the conversation with the
City of Georgetown Permit Technician
- because a strict enforcement of the provisions of the ordinance would result
in unnecessary hardship to this applicant by having to remove and replace in
a confined area of the backyard
- such that the spirit of this ordinance shall be observed and substantial
Justice done, subject to the following limitation:
the planting of trees of substantial height to shade the existing screening
Gambino seconded the motion, which was passed by a vote of 4-0.
Gambino made the motion to adjourn. Bennett seconded. The vote was unanimous. Meeting
was adjourned at 7:28 p.m.
