Georgetown, Texas 78626 Commissioners Present: William Sattler, Chair, Audrey McDonald, Cornelius Daly, Danny Swafford Commissioners Absent: Ken Fuller Staff Present: Bobby Ray, Chief Development Planner, Paula Dessler, Recording Secretary A regular meeting of the Zoning Board Of Adjustments, for consideration and possible action on the f ollowing: William Sattler called the meeting to order at 6:00 1. Action from Executive session-NONE. 2. Review of the minutes from the July 20, 2004 meeting. Motion made by Sattler to approve the minutes as written .Second by Daly. Motion Approved 3-0. McDonald abstained she was not present at the July meeting. 3. Consideration and possible action on a Variance from Section 6.03.020 of the Unified Development Code (UDC) to allow a maximum building height of 53 feet, where 40 feet is allowed, for The City of Georgetown, Block 40, Lot’s 1 & 4, located at 114 E. 7th Street. Staff Presentation Bobby Ray presented the staff report to the Board and explained that the Board must have a unanimous vote in order for the Variance to be approved. Applicant Presentation David Voelter presented the application to the board. Points reviewed: -Explanation of each floor Plan of the proposed building. -Went over various views from downtown and IH 35 to show the minimal and limited impact of the height of the building. Mr. Voelter explained that with setting the penthouses back 10 ft. on all sides the visual impact would be minimal. - Reviewed other buildings on the square that exceed the 40 ft. rule. The Court House, the Parapet of the Masonic Lodge and Courthouse on the Square Restaurant. Mr. Voelter explained that Mr. Bollman must have the Penthouses and the garage in order to move ahead with this project. Citizens To address Russell Phillips with Moreland Properties representing Mr. Bollman spoke on behalf of the project. Mr. Phillips explained that 7th Street does slope downward which again minimizes the view of the penthouses. Also explained that the parking will be an asset to Georgetown for tourist and shoppers. Companies have already shown interest with the development and Mr. Bollman would be living in one of the Penthouses. Board Questions to Staff and Applicant McDonald does not agree with the trade off of parking for the Variance request. The parking garage is small and would not benefit other businesses around the square. How would people know the garage was full? Mr. Phillips explained that a sign could be posted to alert tourist and shoppers t hat the garage was full and that one car could hold up to 4-8 passengers to shop downtown, a benefit for the City. Swafford commented that this was the only property left in the downtown for a project of this size, it’s a unique location and the applicant is in the spirit of the Ordinance by not blocking the Courthouse and various other views. Sattler explained that the 40 foot rule has been around before the UDC and is in effect to maintain the integrity of downtown. Motion by Swafford to Approve the Variance request. Second by Daly. Motion Denied 1-3 IN FAVOR Swafford OPPOSED McDonald Sattler Daly ABSENT Fuller Meeting adjourned at 6:45
