City Council Chambers 101 E. 7th Street, Georgetown, Texas 78626 Members: Dustin Elliott, Vice-chair; Ellen Davis, Secretary; Tom Crawford, Gerald Sensabaugh. Vice-chair Elliott called the meeting to order at 6:00 p.m. 1. Action from Executive Session. There was not an executive session. 2. Consideration and possible action on the Minutes of the regular Board of Adjustment meeting on August 16, 2011. Motion by Sensabaugh to approve the August 16, 2011 minutes. Second by Crawford . Approved. (4-0) 3. Public Hearing and possible action on a Special Exception for a setback modification to allow a covered porch to encroach 6’11” into Myrtlea street side setback, for Glasscock Addition, Block 14, Lots 5 & 6, located at 407 S. Myrtle Street. (RW) SE-2011-003 Staff report by Robbie Wyler. The applicant is requesting Special Exception approval for a setback modification from the Zoning Board of Adjustment (ZBA) to allow an 111.58 square foot connection in between two covered porches that will encroach into the side yard setback. The property is used as a residence and includes only the main dwelling. On July 28, 2011, the subject property was brought to the Historic and Architectural Review Commission (HARC) for Certificate of Design Compliance (CDC) approval for an expansion and renovation to the house. Amongst other design elements of the project was the expansion of an existing 7’ by 5’ covered porch facing Myrtle Street. The applicant provided details to HARC and explained that the existing porch was to be extended south and connect to a future covered porch on the south side of the house. When completed, the porch expansion will connect the existing Myrtle Street porch with the future 5th Street porch, creating a single wrap around covered porch. HARC approved the design of the covered porch expansion pending any future required approvals. Staff determined the proposed porch expansion encroached into the side/street yard setback. Per Unified Development Code (UDC) Section 6.03.050.A, Residential Single-Family District Lot and Dimensional Standards, the side setback shall be a minimum of 6 feet. However, any street-facing yard shall have a minimum of 10 feet. The subject covered porch, more specifically the connection between the existing 7’ by 5’ covered porch facing Myrtle Street and the future 8’ covered porch Zoning Board of Adjustment Agenda, September 20August 16, 2011 Page 2 of 2 spanning the south side of the house, encroaches 6’11” into the 10’ setback, a distance of about 3’1” from the west property line and 21’1” from Myrtle Street. The total area of new covered porch within the setback is 111.58 square feet. Due to the encroachment into the side/street yard setback, a Special Exception for Setback Modification must be approved by the ZBA in order for the connecting portion of the covered porch between the existing Myrtle Street porch and future 5th Street porch to be permitted. Per UDC Section 3.15.B, the ZBA shall have the authority to hear and decide Special Exceptions to the terms of this Code when the Code requires the Board to do so. Vice-chair Elliott invited the applicant to speak. Sarah Milburn stated she and her husband would like to extend the existing porch around the south corner of the house and along the south side of the home. They want this extension to improve the look of the home as well as to provide shade to the bedrooms along the south side of the house. The new part of the porch will follow the same line as the existing porch. This extension would extend the existing porch 19’3” along the west side of the house. (11’3” to the end of the house and an additional 8’ for the wrap-around porch. The new porch design has been approved by the Historical Architectural Review Commission during the July 2011 meeting. She also stated she will be happy to answer any questions. There was a discussion between Commissioners and staff regarding qualifications for the set-back modification application. Motion by Seansabaugh to approve the Special Exception for Setback Modification to allow a connecting covered porch between an existing Myrtle Street-facing porch and a future 5th Street-facing porch to encroach 6’11”.
