HomeMy WebLinkAboutRES 042809-U - Application Fund FM 1460RESOLUTIONNO 09 c g A Resolution of the City Council of the City of Georgetown, Texas, Supporting the FM 1460 Reconstruction Project and Authorizing the Application for Pass -Through Financing for the FM 1460 Reconstruction Project, to Improve a Functionally Obsolete Roadway, Expand Economic Development Opportunities and Expand upon a City of Georgetown Priority Bond Project to Benefit the Central Texas Region, and Providing an Effective Date. WHEREAS, Subchapter E, Chapter 222.104 of the Texas Transportation Code and the Administrative Rules adopted thereunder in Subchapter E, §5.51 — 5 60 (Pass -Through Fares and Tolls) authorize the Texas Department of Transportation ("Departmmment') to enter into an agreement with a public entity that provides for the payment of pass -through financing to the public entity as reimbursement for the construction, maintenance or operation of a toll or non - toll facility on the state highway system by the public entity, and; WHEREAS, the Texas Transportation Commission has issued the 2009 Program Call for the Pass -Through Finance Program; and WHEREAS, the Georgetown City Council has prioritized the FM 1460 improvements as a top priority for the City of Georgetown and supported passage of Bond Program to finance portions of those improvements within its corporate limits; and WHEREAS, the completion of the FM 1460 project, including portions outside of the City of Georgetown Bond Program, will complete a priority project of the Capital Area Metropolitan Planning Organization (CAMPO) Mobility 2030 Plan; and WHEREAS, portions of the FM 1460 corridor outside of the City's corporate or ETJ limits are under development by the Department, Williamson County anc. the City of Round Rock, from FM 1460 Centerline Station 795+00 south to State Highway 79; and WHEREAS, FM 1460 improvements to be identified in the City of Georgetown's Pass - Through Finance application will "dose the gap" in the FM 1460 corridor improvement program, from Quail Valley Drive and FM 1460 Centerline Station 617+46 south to FM 1460 Centerline Station 795+00; anc WHEREAS, FM 1460 is a Department highway system project that is needed and eligible for funding under the Department's Pass -Through Financing Program; and City of Georgetown FM 1460 Resolution of Application and Support Pagel of WHERAS, the City of Georgetown supports the Southeast Georgetown corridor for targeted infrastructure improvements and economic development opportunities between IH35, Westinghouse Road, FM 1460 and Georgetown inner Loop; and WHEREAS, the City of Georgetown wants to ensure that the transportation network in Georgetown, Williamson County and Central Texas is safe and addresses the economic development needs of all citizens. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS' SECTION 1: The foregoing recitals are hereby found to be true anc correct and are incorporated herein by reference for all purposes. SECTION 2: The Georgetown City Council encourages and supports the City of Georgetown application for the Pass -Through Finance Programto complete the FM 1460 project in a timely and reasonable manner. SECTION 3: The Georgetown City Council requests that the Texas Transportation Commission, Department, CAMPO, Williamson Count) , the City of Round Rock and City of Georgetown work to complete improvements to the entire FM 1460 project in a timely manner using the Pass -Through Finance Program and an) other means possible. SECTION 4: The Mayor and City Manager are directed to submit t-re aforementioned project to the Texas Transportation Commission and Department, and are authorized to complete and sign all applications necessary under the 2009 Program Cai1 for the Pass -Through Program. SECTION 5: If any provisions of this Resolution or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Resolution IA hich can be given effect without the invalic provision or application and to this end the provisions of this Resolution are hereby declared to be severable. SEC I ION 6: The Mayor of Georgetown is hereby authorized to sign this Resolution and the City Secretary to attest. This Resolution shall become effective on the date of its approval by the Georgetown City Council.
