HomeMy WebLinkAboutRES 031009-E - ANX Sun City Softball FieldRESOLUTION NO A Resolution of the City Council of the City of Georgetown, Texas, Granting a Petition for Voluntary Annexation of Approximately 0.73 acres, more or less, in the Burrel Eaves Survey, Abstract 229 Owned by Del Webb Sun City Texas; and Directing Publication of Notice and Public Hearings for Proposed Annexation WHEREAS, the owners of the hereinafter described area of land have requested the governing body of the City of Georgetown, pursuant to Local Government Code Section 43.028, by written petition through a development agreement, properly acknowledged, to annex said area of land into the City of Georgetown, to -wit: All of that certain 0.73 acres, more or less, in the Burrel Eaves Survey, Abstract 229, north of Sun City Boulevard, for Sun City Softball Field, that is more particularly described by metes and bounds in Exhibit "A," and shown on the map attached hereto as Exhibit "B," both of which Exhibits are attached hereto and incorporated herein by reference as if set forth in full; and WHEREAS, the said area of land, is contiguous to the existing city limits of the City of Georgetown, and is vacant and without residents or has fewer than three qualified voters residing on it. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CIl'Y OF GEORGETOWN, TEXAS That the said Petition, being proper and according to law, shall be, and it is hereby, granted; and, further, the City Secretary is directed to commence the publication of notices of two public hearings to be held March 10, 2009, and on March 24, 2009 before the City Council on the subject of the proposed annexation of the said area into the City of Georgetown; and further, to place upon the City Council Agendas for April 14, 2009, and on or before June 23, 2009, the consideration of the passage of an ordinance annexing said area into the City of Georgetown. Oa 009 -D A RESOLUTION BY THE CITY OF GEORGETOWN, TEXAS ("CITY") TO IMPLEMENT EMISSION REDUCTION ACTIONS TO ASSIST IN CLEAN AIR EFFORTS AND TO MAINTAIN WILLIAMSON COUNTY'S DESIGNATION AS "ATTAINMENT" IN REGARDS TO GROUND LEVEL OZONE STANDARDS; MAKING OTHER FINDINGS RELATED TO THE SUBJECT AND DECLARING AN EFFECTIVE DATE. WHEREAS, The Citizens of Williamson County recognize the value of and are conscious of the need for clean air; and WHEREAS, New ozone standards as promulgated by the US Environmental Protection Agency expose Williamson County and its citizens to possible designation as a non -attainment area under the new standards; and WHEREAS, Current and on -going efforts of Williamson County and communities to use approved emission reduction measures, including enhanced vehicle inspection and maintenance programs, provided support to the Texas Commission on Environmental Quality to omit Williamson County from a proposed list of non -attainment counties; and WHEREAS, Concerted effort to reduce ozone forming emissions by the citizens, communities, schools and industry in Williamson County during the April through October ozone season will help preclude Williamson County being listed as non - attainment for 2009 and future years; and Resolution No. Community Clean Air Page 1 of 3 WHEREAS, Designation of non -attainment will inhibit local flexibility in planning and development and create economic impacts to the citizens of Williamson County for up to twenty years. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are hereby in all things approved and adopted. SECTION 2. The City Council hereby finds that this Ordinance implements Effective Governance Vision Statement 4.0.0 of Georgetown's 2030 Comprehensive Plan, which states: "Georgetown has achieved a high level of service coordination, both internally and with County, State and other city service providers."; and further finds that the enactment of this ordinance is not inconsistent with or in conflict with any other Comprehensive Plan Policies. SECTION 3. That The City of Georgetown affirms its commitment to helping reduce ozone forming emissions by implementing actions that are accepted by TCEQ in line with existing reduction measures and agrees to assist in public awareness and outreach on the need for reduction measures to help voluntarily secure an ongoing designation of "in attainment" under the I\ational Ambient Air Quality Standards for Ground Level Ozone. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. SECTION 5. This resolution shall become effective from and after its passage.
