A RESOLUTION AUTHORIZING THE TEXAS HOUSING FOUNDATION TO EXERCISE
ITS POWERS WITHIN THE TERRITORIAL BOUNDARIES OF THE CITY OF
GEORGETOWN, TEXAS AND AUTHORIZING A COOPERATION AGREEMENT.
WHEREAS, there exists in the City of Georgetown a shortage of affordable safe and
sanitary housing available to residents at rents they can afford; and
WHEREAS, the Texas Housing Foundation ("Foundation") has significant experience
and expertise in successfully providing, developing, financing and managing housing projects
that are affordable to qualified residents and are assets to the community; and
WHEREAS, Texas Local Government Code, Section 392.017 (d) requires that the
governing body of a municipality adopt a resolution declaring a need for a municipal housing
authority to exercise its powers in another jurisdiction, and authorizing a cooperation
agreement under Section 392.059;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The City Council is the governing body of the City of Georgetown.
SECTION 2. The facts and recitations contained in the preamble of this resolution
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim.
SECTION 3. Pursuant to Texas Local Government Code, Section 392.017(d(1), the
City Council declares that there is a need for the Foundation to exercise its powers in
the territorial boundaries of the City of Georgetown to provide decent, safe and sanitary
housing that is affordable for qualified residents of Georgetown. The Foundation is
hereby authorized to exercise its powers in the territorial boundaries of the City of
Georgetown.
SECTION 4. Pursuant to Texas Local Government Code, Section 392.017(d)(2)
and the Cooperation Agreement attached hereto and incorporated herein between the
Foundation and the City of Georgetown, the Foundation is hereby authorized under
Texas Local Government Code Section 392.059(a) to exercise its powers within the City
of Georgetown. The City of Georgetown agrees to cooperate with the Foundation to
allow the Foundation to provide housing for qualified residents in the territorial
boundaries of the City of Georgetown consistent with the terms of the Cooperation
Agreement. The Foundation is authorized to exercise its powers under the Texas
Housing Authorities Law, Texas Local Government Code Chapter 392, to finance, plan,
undertake, construct, or operate housing projects in the City of Georgetown, consistent
with the terms of the Cooperation Agreement. the Mayor is hereby authorized to
execute the Cooperation Agreement on behalf of the City of Georgetown.
SECTION 5. This Resolution pertains only to the land and project previously
referred to as Sierra Ridge If an offer is made for the property, the Housing Authority
should consider it and that the engineering and drainage plans made to the property
also incorporate and benefit the adjacent property as well.

SECTION 6. This resolution shall be effective immediately upon adoption.
