RESOLUTION NO. as .2J8&2 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, APPROVING OF AND CONSENTING TO A REQUEST FOR THE INCLUSION OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF GEORGETOWN IN AN EMERGENCY SERVICES DISTRICT; PROVIDING FOR THE EXPIRATION OF THE CONSENT PROVIDED HEREIN; MAKING OTHER FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, in order to provide emergency services in Williamson County a group of individuals have begun the process of forming an emergency services district; and, WHEREAS, part of the proposed district lies within the extraterritorial jurisdiction of the City of Georgetown; and, WHEREAS, state law requires the consent of the City Council in order to include within the aforesaid district any land lying with the City's extraterritorial jurisdiction; and, WHEREAS, the individuals who are proposing the emergency services district to be named the "Williamson County Emergency Services District No. 9", submitted a letter to the City of Georgetown dated February 3, 2006 formally requesting the required consent and, WHEREAS, in order for any of the City's extraterritorial jurisdiction to be included in the proposed district, the City Council must approve the aforesaid request within 60 days of its submission; WHEREAS, an election has been called for May 13, 2006 for voters to consider approval of the creation of the proposed Emergency Services District No. 9. Resolution No. anya Williamson County Emergency Services District No. 9 Consent Resolution Page 1 of 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section 1. That the request of the proposed "Williamson County Emergency Services District No. 9" to include the extraterritorial jurisdiction of the City of Georgetown in an emergency services district is attached hereto as Exhibit A and for all purposes made a part hereof. Section 2. That the map and description of the boundaries of the aforesaid emergency services district are attached hereto as Exhibit B and for all purposes made a part hereof. Section 3. That the City Council of the City of Georgetown, Texas, hereby approves the request in Exhibit A hereto and consents to the inclusion of the territory described in Exhibit B hereto in the aforementioned emergency services district. Section 4. That the City Council finds that the meeting at whichthis resolution was passed was conducted in strict compliance with the provisions of the Texas Open Meetings Act (Texas Government Code Chapter 551). Section 5. That the approval and consent granted herein shall automatically expire six months from the date hereof. Section 6. That this resolution shall become effective from and after its passage. Carls Brown & Carls, LLP City Attorney Resolution No. C Williamson County Emergency Services District No. 9 Consent Resolution Page 3 of 3 /)e. , ©3fiV V Y/ - Exhi*i f' 2241, 215 WILLIAMSON COUNTY EMERGENCY SERVICES DISTRICT NO. 9 BEGINNING at a point where the Williamson -Travis County line intersects the territorial boundary of Williamson County Emergency Services District No.. 3, being the southwesternmost corner of the territorial boundary of said Williamson County Emergency Services District No, 3 and its mtersection with the Williamson -Travis County line; THENCE, westerly the following the southern Williamson -Travis County line until it intersects with the territorial boundary of Williamson County Emergency Services District No.. 1, being the southeasternmost corner of Williamson County Emergency Services District No. 1; THENCE, northerly and then westerly along the territorial boundary of Williamson County Emergency Services District No.. 1 (also, for reference only, being and roughly following the centerline and right of way of the Southern Pacific Railroad) to its intersection with the territorial boundary of Williamson County Emergency Services District No.. 2; THENCE, easterly and northerly along the eastern territorial boundary of Williamson County Emergency Services District No. 2 to its intersection with the south tight of way of Farm to Market Road 1431 and where the territorial boundary of Williamson County Emergency Services District No. 2 turns to a westerly direction; THENCE, westerly along the northern territorial boundary of Williamson County Emergency Services District No. 2 until said territorial boundary line intersects with the territorial limits of the City of Cedar Park, Iexas, the eastern right of way of County Road 175 and an imaginary line drawn in a southerly direction from the western boundary and corner of the territorial limits of Williamson County Municipal Utility District No. 9 (also being, for reference only, roughly in the vicinity of the southwestern corner of Vista Oaks Section 7B, R457681); THENCE, northerly along said imaginary line to and then following the western boundary of Williamson County Municipal Utility District No.. 9 to the point where said line intersects with the northern territorial boundary of Williamson County Municipal Utility District No. 9, THENCE, easterly along the northern territorial boundary of Williamson County Municipal Utility District No 9 to the point where said line intersects the territorial limits of the City of Round Rock, Texas; IHENCE northerly and then easterly along the territorial boundary of the City of Round, Texas to the point where said line intersects with the territorial limits of the Georgetown Independent School District also being the northeastern corner of that certain tract owned by MDSR GP, Inc., R41'7245; 019.19959/metes and bounds (long) Page 1 of 2 EXHIBIT .B THENCE, southerly along the territorial limits of the Georgetown Independent School District to the point where said line intersects with the southern boundary line of that certain tract owned by the Highlands at Mayfield Ranch, Ltd , R040295 being the southwestern corner of said tract; THENCE, easterly along the southern territorial boundary of the Georgetown Independent School District (and, generally, the southern boundary of that certain tract owned by the Highlands at Mayfield Ranch, Ltd , R040295) until said line intersects with the southern territorial boundary of Williamson County Emergency Services Distract No. 8; THENCE, continuing easterly following along the southern territorial boundary of Williamson County Emergency Services District No.. 8 until said line intersects with the territorial limits of Williamson County Emergency Services District No. 3; THENCE, southerly and easterly along the western territorial boundary of Williamson County Emergency Services District No. 3 to the southern Williamson -Travis County line and the PLACE OF BEGINNING; SAVE AND EXCEPT the territorial limits of the City of Round Rock, Texas, the City of Cedar Park, Texas and the City of Austin, Texas, as such territorial limits existed as of January 9, 2006. 019.19959/metes and bounds (lone) Page 2 of 2 EXHIBIT B
