THE STATE OF TEXAS WILLIAMSON COUNTY CITY OF GEORGETOWN I, Shirley J. Rinn, the Deputy City Secretary of the City of Georgetown, Texas (the "City") hereby certify as follows: 1. The City Council of the City convened in Open Meeting on the 23rd day of May, 2006 at the City Council Chambers, and the roll was called of the duly constituted officers and members of the City, to -wit Gary Nelon — Mayor Doug Smith — Mayor-Pro-Tem Councilmember District 3 Patty Eason — Councilmember District 1 Gabe Sansing — Councilmember District 2 Henry Carr — Councilmember District 4 John Kirby — Councilmember District 5 Farley Snell — Councilmember District 6 Ben Oliver — Councilmember District 7 Paul Brandenburg, City Manger Patricia E Carls City Attorney Shirley J. Rinn, Deputy City Secretary And all of the persons were present except for the following absentees: Doug Smith, thus constituting a quorum. Whereupon, among other business, the following was transacted at the meeting. A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE OFFICIAL RESULTS OF THE CITY OF GEORGETOWN GENERAL ELECTION HELD ON MAY 13, 2006 TO BE EFFECTIVE IMMEDIATELY UPON ITS PASSAGE, was duly introduced for the consideration of the City Council. It was then duly moved and seconded that the Resolution be passed and be effective immediately; and, after discussion, said motion carrying with it the passage of the Resolution, prevailed by the following vote: Certificate of May 13, 2006 Election Page 1 of 2 AYES • 6 NOES* 0 2. A true, full and correct copy of the Resolution passed at the meeting described in the above and foregoing paragraphs is attached to and follows this Certificate; that the Resolution has been duly recorded in the City Council's minutes of the meeting; that the above and foregoing paragraphs are a true, full, and correct excerpt from the City Council's minutes of the meeting pertaining to the passage of the Resolution; that the persons named in the above and foregoing paragraphs are the duly chosen, qualified, and acting officers and members of the City Council as indicated therein; that each of the officers and members of the City Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the meeting, and each of the officers and members consented, in advance, to the holding of the meeting for such purpose, and that the meeting was open to the public and public notice of the time, place and purpose of the meeting was given all as required by Chapter 51, Texas Government Code. 3. The Mayor of the City has approved and hereby approves the Resolution; that the Mayor and the Deputy City Secretary of the City have duly signed the Resolution; and that the Mayor and the Deputy City Secretary of the City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of the Resolution for all purposes. [Seal] RESOLUTION NO. 052306-L A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF GEORGETOWN GENERAL ELECTION HELD ON MAY 13, 2006 WHEREAS, the City Council of the City of Georgetown, Texas ordered a general election to be held on Saturday, May 13, 2006, for the purpose of the following: To elect a Councilmember from City of Georgetown Single -Member District 5; and WHEREAS, the City Council has investigated all matters pertaining to said election, including the ordering, giving notice, holding and making returns of said election; and WHEREAS, the election officers who held said election have prepared the returns of the results thereof, and the returns have been delivered to the City Council; and WHEREAS, it appears from the returns, duly and legally made, that the following votes were cast: FOR COUNCILMEMBER DISTRICT 5 Pat Berryman 317 Michael Jackson 208 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION I. The City Council officially finds and determines that the election was duly called; that proper notice of the election was given in accordance with law, that the election was held in accordance with law; that returns of the results of the election have been made and delivered, and that the City Council has canvassed the returns, all in accordance with the law and the resolution calling the election. It appears from said returns, duly and legally made, that Pat Berryman was duly elected as Councilmember for City Single -Member District 5. SECTION III. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall, a place convenient and readily accessible to the general public, and said notice was posted and remained posted continuously for at least 72 hours preceding the scheduled time of the meeting. A copy of the posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. PASSED AND APPROVED on this 23rd day of May, 2006.
