HomeMy WebLinkAboutRES 061306-P - ATMOS Rate IncreaseRESOLUTION NO. 0 lc 13 0 to P RESOLUTION BY THE CITY OF GEORGETOWN, TEXAS ("CITY") SUSPENDING THE EFFECTIVE DATE FOR NINETY DAYS IN CONNECTION WITH THE RATE INCREASE FILING OF ATMOS ENERGY CORPORATION, MID-TEX DIVISION ON MAY 31, 2006; FINDING THAT THE MEETING COMPLIES WITH THE OPEN MEETINGS ACT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE WHEREAS, Atmos Energy Corporation, Mid -Tex Division ("Atmos Energy") filed a Statement of Intent with the City of Georgetown, Texas ("City") to increase its rates on a system -wide basis by more than $60 million and also substantially change its rate design for residential customers so that the more gas that is used the cheaper the rate; and WHEREAS, the City has joined with other local regulatory authorities to form Atmos Texas Municipalities ("ATM"); and WHEREAS, the rate filing is thousands of pages in length with more than a half dozen technical experts; and WHEREAS, it is not possible for the City to complete its review of Atmos Energy's filing of May 31, 2006 within 35 days; and WHEREAS, the City will need at least 100 days before it is ready to adopt a final decision as a local regulatory authority with regard to Atmos Energy's filing. Res. ma 13 0Co- r Pale 1 of 3 Paies NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL/COMMISSION FOR THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the Utility Policy Statement 11.00 of the Century Plan - Policy Plan Element, which states: "City owned, sponsored or managed utilities are competitively priced and provide safe, adequate and reliable services to all customers." and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. Section 2.That the findings set out in the preamble are in all things hereby approved. Section 3. The effective date for Atmos Energy's filing of May 31, 2006 is July 5, 2006 and hereby suspended for ninety days or at least until October 3, 2006. Section 4. The statutory timeline may be further extended if Atmos Energy does not provide timely and meaningful public notice of its request to increase rates or if its rate filing package is materially deficient. Section 5. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Res.
