RESOLUTION NO. 0t 0:010 Al A Resolution of the City Council of the City of Georgetown, Texas Authorizing Registration in the U.S. Communities Cooperative Purchasing Alliance; Making other Provisions Relating to Participation in the US Communities Program; Providing a Severability Clause; and Providing and Effective Date. WHEREAS; WHEREAS, WHEREAS WHEREAS, the City of Georgetown is a Texas Horne Rule Municipal Corporation; and U.S. Communities Purchasing and Finance Agency is a California Non -Profit Public Benefit Corporationwhose purpose is to (i) purchase, lease, finance, participate, assist, or advise in the purchase, lease or financing of equipment, materials, products or other property or services involving one or more States or politicalsubdivisions thereof; of (ii) participate in conduit financing transactions with one or more States or political subdivisions thereof, or assist or advise one or more States or political subdivisions thereof with respect to their conduit financing transactions. the Association of School Business Officials International (ASBO), the National Association of Counties (NACo), the National. Institute of Governmental Purchasing (NIGP), th.e National. League of Cities (NLC), and the United States Conference of Mayors (USCM), jointly sponsor the U.S. Communities Government Purchasing Alliance, and cities, counties, schools, higher educational institutions, special districts, state agencies, and nonprofits ranging across all 50 states use U.S Communities as an important strategic sourcing tool. U.S. Communities is a nonprofit instrumentality of government that assists public agencies in reducing the cost of purchased goods through pooling the purchasing power of public agencies nationwide, which is accomplished through competitively solicited contracts for quality products through lead public agencies. WHEREAS, The "Texas Interlocal. Cooperation Act", Tex. Gov. Code Ch. 791, provides, in relevant part, as follows: § 791.025 Government Contracts for Purchases (a) A localgovernment, including a council of governments, may agree with another local government or with the state or a state agency, including the General. Services Commission, to purchase goods and services. Resolution No. 0 Participation in. US Communities Cooperative Purchasing Alliance Pagel of 4 (b) A local government, including a council of governments, may agree with another Local government, including a nonprofit corporation that is created and operated to provide one or more governmental functions and services, or with the state or a state agency, including the General Services Commission, to purchase goods and any services reasonably required for the installation, operation, or maintenance of the goods. This subsection does not apply to services provided by firefighters, police officers, or emergency medical personnel (c) A local government that purchases goods and services under this section satisfies the requirement of the local government to seek competitive bids for the purchase of the goods and services. WHEREAS, Chapter 271, Subchapter F "Cooperative Purchasing Program," Tex. Local Gov. Code Secs. 271.101 - 012, provides that a local government may participate in a cooperative purchasing program with other local governments or a local cooperative organization established to provide local governments access to contracts with vendors for the purchase of materials, supplies, services, or equipment. WHEREAS the City of Georgetown desires to participate in the U.S. Communities Coopei ative Purchasing Alliance for the purpose of fulfilling and executing its respective public governmental purposes, goals, objectives, programs and functions. WHEREAS; the City of Georgetown has reviewed the benefits of participating in this program and based on this review has concluded the program will provide the best value to taxpayers of this municipality through the anticipated savings to be realized. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Georgetown as follows: Section 1: The City Council finds and declares that the foregoing recitals are true and connect and are incorporated herein by reference for all purposes, and that the adoption of this Resolution is in conformance with the following Century Plan Policy Statements: 13.0 All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided. 15.0 The City manages its resources in a sound and fiscally conservative manne Resolution No. °snob Participation in US Communities Cooperative Purchasing Alliance Page 2 of 4 Section 2: The City of Georgetown Purchasing Manager or her designee is authorized to register as Participating Public Agency for the U.S. Cornrnunities program on behalf of the City of Georgetown. Section 3: The City Council agrees to the general terms and conditions of the Master Intergovernmental Cooperative Purchasing Agreement (MICPA), attached hereto as "Exhibit A." Section 4. If any provision of this Resolution or applicationthereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Resolution. which can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are hereby declared to be severable.
