RESOLUTION NO. 04/Z ©5 m A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, DECLARING CERTAIN CITY -OWNED REAL P ROPERTY AS SURPLUS PROPERTY THAT SERVES NO PUBLIC P URPOSE; AUTHORIZING THE SALE THEREOF; ESTABLISHING THE MINIMUM ACCEPTABLE BID FOR THE PROPERTY; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, in 1995 and 1996, the City acquired the following described real property (the `Property"), as part of the rerouting of Shell Spur Road at its intersection with Logan Ranch Road for the placement of water, wastewater and electric utility improvements associated with the development of Sun City Georgetown: Being a +1.473 acre tract of land described as Lot 1, Amended Plat of Pepper Subdivision, a Resubdivision of Lot 29 Logan Ranch Section 1, a subdivision of record in Cabinet Y, Slides 257-258, Plat Records, Williamson County, Texas (the "Property") WHEREAS, the subject utility improvements are complete; and WHEREAS, the above Property constitutes the remainder of the property that was n ecessary to construct the improvements, and WHEREAS, the Property no longer serves a public purpose and no future public n eed for the Property is anticipated; and WHEREAS, the City Council finds it to be in the best interest of the citizens of Georgetown to declare the Property as surplus property and offer it for sale to the public by solicitation of sealed bids. N OW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: S ECTION 1 The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements Finance Policy End 14.00 of the Century Plan - Policy Plan Element, which states. "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided", and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. The above -described Property is hereby declared as surplus property by the City Council of the City of Georgetown and City staff is hereby directed to cause the sale of the Property by soliciting sealed bids from the public in accordance with State law. S ECTION 3. The minimum bid for consideration by the City shall be the fair market value of the Property, as determined by an appraisal prepared a certified appraiser retained by the City. S ECTION 4. The City staff is hereby directed to prepare the notice to the general public of the offer of the land for sale for publication in the Williamson County Sun in accordance with the requirements of Chapter 271 of the Texas Local Government Code. S ECTION 5. The City shall not be required to accept any bid or offer or to complete a sale of the Property. S ECTION 6. The Mayor is hereby authorized to sign this Resolution and the City Secretary to attest thereto on behalf of the City of Georgetown. S ECTION 7.
