THE STATE OF TEXAS WILLIAMSON COUNTY CITY OF GEORGETOWN I, Sandra D Lee, the City Secretary of the City of Georgetown, Texas (the "City") hereby certify as follows: 1. The City Council of the City convened in Open Meeting on the 17th day of May, 2005 at the City Council Chambers, and the rollwas called of the duly constituted officers and members of the City, to -wit Gary Nelon — Mayor Doug Smith — Mayor-Pro-Tem Councilmember District 3 Patty Eason — Councilmember District 1 Gabe Sansing — Councilmember District 2 Henry Carr — Councilmember District 4 John Kirby — Councilmember District 5 Farley Snell — Councilmember District 6 Ben Oliver — Councilmember District 7 Paul Brandenburg, City Manger Patricia E. Calls, City Attorney Sandra D Lee, City Secretary And all of the persons were present except for the following absentees: 3o h n Ki r bar , thus constituting a quorum. Whereupon, among other business the following was transacted at the meeting: A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE OFFICIAL RESULTS OF THE CITY OF GEORGETOWN GENERAL/SPECIAL ELECTION HELD ON MAY 7, 2005 TO BE EFFECTIVE IMMEDIATELY UPON ITS PASSAGE, was duly introduced for the consideration of the City Council. It was then duly moved and seconded that the Resolution be passed and be effective immediately; and, after discussion, said motion carrying with it the passage of the Resolution, prevailed by the following vote: Certificate of May 7, 2005 Election Wes, 05/705 - B Page 1 of 2 AYES NOES: 2. A true, full and correct copy of the Resolution passed at the meeting described in the above and foregoing paragraphs is attached to and follows this Certificate; that the Resolution has been duly recorded in the City Council's minutes of the meeting; that the above and foregoing paragraphs are a true, full, and correct excerpt from the City Council's minutes of the meeting pertaining to the passage of the Resolution; that the persons named in the above and foregoing paragraphs are the duly chosen, qualified, and acting officers and members of the City Council as indicated therein; that each of the officers and members of the City Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the meeting, and each of the officers and members consented, in advance, to the holding of the meeting for such purpose, and that the meeting was open to the public and public notice of the time, place and purpose of the meeting was given all as required by Chapter 51, Texas Government Code. 3. The Mayor of the City has approved and hereby approves the Resolution; that the Mayor and the City Secretary of the City have duly signed the Resolution, and that the Mayor and the City Secretary of the City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of the Resolution for all purposes. Lee, City Secretary Certificate of May 7, 2005 Election Page 2 of 2 RESOLUTION NO. 06/705 V9 A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE OFFICIAL RESULTS OF THE CITY OF GEORGETOWN GENERAUSPECIAL ELECTION HELD ON MAY 7, 2005 TO BE EFFECTIVE IMMEDIATELY UPON ITS PASSAGE. WHEREAS, the City Council of the City of Georgetown, Texas ordered an election held on Saturday, May 7, 2005, for the purpose of the following: To elect a Mayor of the City of Georgetown and Councilmembers from City of Georgetown Single -Member Districts 2, and 6; and for the purpose of seeking voter response to the question of whether to increase the sales tax in the City of Georgetown at the rate of one -eighth of one percent and the adoption of an additional sales and use tax within the city at a rate of one -eighth of one percent to be used to reduce the property tax rate, and to three propositions that would authorize the use of such sales and use tax proceeds for specific purposes. WHEREAS, the City Council has investigated all matters pertaining to said election, including the ordering, giving notice, holding and making returns of said election, and WHEREAS, the election officers who held said election have prepared the returns of the results thereof, and the returns have been delivered to the City Council; and WHEREAS, it appears from the returns, duly and legally made, that each of the candidates received the following votes MAYOR Gary Nelon DISTRICT 2 Clare Easley Gabe Sansing DISTRICT 6 Farley Snell 2005 General/Special Election Canvass Resolution No. 06770 5-13 Page 1 of 3 Pages 1,966 132 175 82 WHEREAS, it appears from said returns, duly and legally made, that the propositions related to an increase in the sales and use tax and property tax relief received the following votes: Proposition 1 The adoption of a sales and use tax within the city for the promotion and development of new and expanded business enterprises at the rate of one -eighth of one percent and the adoption of an additional sales and use tax within the city at a rate of one -eighth of one percent to be used to reduce the property tax rate, as authorized by Section 4A of the Development Corporation Act of 1979, as amended (Article 5190.6 Vernon's Tex. Rev. Civ. Stan Ann.). For: 1,321 Against: 1,151 Proposition 1 was approved by the voters. A total of 2,472 votes were cast, and Proposition 1 passed by a margin of 170 votes. Proposition 2 The use of the sales and use tax proceeds authorized under Proposition No. 1 and 4A(s) and 4B(a)(2)(A) of the Development Corporation Act of 1979, as amended (Article 5190.6 Vernon's Tex Rev. Ctv. Stan Ann.) to fund public park purposes and events; parks and park facilities; and open. space improvements, mcluding other related improvements necessary therefor and the payment of maintenance and operating costs, if any For: 996 Against: 1,417 Proposition 2 was not approved by the voters. A total of 2,413 vote were cast, and Proposition 2 failed by a margin of 421 votes. Proposition 3 The use of the sales and use tax proceeds authorized under Proposition 1 and Sections 4A(s) and 4B(a)(2)(C) of the Development Corporation Act of 1979, as amended (Article 5190.6 Vernon's Tex Rev. Civ. Stan. Ann.) to develop and expand affordable housing, including other related improvements necessary therefor and the payment of maintenance and operating costs, if any For: 714 Against: 1,684 Proposition 3 was not approved by the voters. A total of 2,398 votes were cast, and Proposition 3 failed by a margin of 970 votes. Proposition 4 The use of the sales and use tax proceeds authorized under Proposition 1 and Sections 4A(s) and 4(B)(a) of the Development Corporation Act of 1979, as amended (Article 5190.6 Vernon's Tex. Rev. Civ Stat. Ann.) for project costs for streets, roads, drainage, and other related transportation system improvements, including the payment of maintenance and operating expenses associated with such authorized projects. For: 1,139 Against: 1,280 Proposition 4 was not approved by the voters. A total of 2,419 votes were cast, and Proposition 4 failed by a margin of 141 votes. 2005 General/Special Election Q Canvass Resolution No. ©�.5/7p5-44 Page 2 of 4 Pages NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION I. The City Council officially finds and determines that the election was duly called; that proper notice of the election was given in accordance with law; that the election was held in accordance with law; that returns of the results of the election have been made and delivered, and that the City Council has canvassed the returns, all in accordance with the law and the resolution and ordinance calling the election. SECTION II. The City Council officially finds and determines that Gary Nelon was elected as Mayor of the City of Georgetown, Texas; Gabe Sansing was elected as Councilmember for District 2, and Farley Snell was elected as Councilmember for District 6. SECTION III. The City Council officially finds and deteuntines that Proposition 1 was approved by the voters, and that Propositions 2, 3, and 4 were not approved by the voters SECTION IV. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall, a place convenient and readily accessible to the general public, and said notice was posted and remained posted continuously for at least 72 hours preceding the scheduled time of the meeting.
