RESOLUTION NO. 0 726 05- N A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS OPPOSING THE APPLICATIONS BY THE CITY OF LEANDER, TEXAS RELATING TO CERTIFICATE OF CONVENIENCE AND NECESSITY NOS. 10302 AND 20626 (APPLICATION NOS. 34789-C AND 34790-C); SOAH DOCKET NO. 582-05-7095; TCEQ DOCKET NO. 2005-0864-UCR; AUTHORIZING THE OPPOSITION OF THE PENDING PERMIT APPLICATION BEFORE THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY AND THE STATE OFFICE OF HEARING EXAMINERS; AUTHORIZING THE RETENTION OF THE LAW FIRM OF TIEMANN, SHAHADY, AND HAMALA, P.C., AND PROVIDING THAT RESOLUTION IS EFFECTIVE UPON PASSAGE. WHEREAS, the City of Georgetown is a Home Rule municipal corporation organized and operating under its Home Rule Charter and the laws of Texas; and WHEREAS, the City of Leander has applied to the Texas Commission on Environmental Quality ("TCEQ") for amendment of Certificates of Convenience and Necessity relating to retail water and wastewater services referred to as CCN Nos. 10302 and 20626 (Application Nos. 34789-C and 34790-C); SOAH Docket No. 582-05- 7095; TCEQ Docket No. 2005-0864-UCR (collectively, the "CCN Applications"); and WHEREAS, the area within the CCN Applications includes land owned by the City of Georgetown as well as land that will, in the future, be conveyed to the City of Georgetown by Mr. and Mrs. Jack Garey consisting of a 525-acre tract of land (the "Garey Tract") that has been declared to be a gift to the City of Georgetown and used as a public park. Mr. and Mrs. Garey announced in 2004 that the entire Garey Tract would be conveyed, over time, to the City of Georgetown for park purposes and the first conveyance of 100 acres was completed in December 2004. WHEREAS, attached hereto as "Attachment A" is a copy of the January 6, 2005 letter from Mr Garey to the City of Georgetown expressing his desire for the Garey Tract to be included in the City of Georgetown's retail water and sewer service area so that the Garey Tract can be provided with the same level of service that the City of Georgetown Resolution No. 07.24 05' -1- provides to its other public parks. The location of the Garey Tract is shown on the maps attached hereto as "Attachment B-1 and B-2." WHEREAS, it is in the best interests of the City of Georgetown, the citizens of the City, and the customers of the City's water and wastewater utility to take the necessary measures provide water and wastewater services to land that it owns and/or will own, including but not limited to protesting the CCN Applications. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Part 1: The City Council finds that all recitations set forth above are true and correct and the recitals are incorporated herein by reference as if set forth in full. Part 2: The City Council hereby declares its opposition to the applications filed by the City of Leander, Texas for amendment of Certificates of Convenience and Necessity Nos 10302 and 20626 (Application Nos. 34789-C and 34790-C); SOAH Docket No. 582- 05-7095; TCEQ Docket No. 2005-0864-UCR (collectively, the "CCN Applications"). Part 3. The City Council hereby authorizes the City Manger, the Assistant City Manager for Utilities, the City Attorney, and their designees to take all actions necessary to protect the City's interests in regard to the CCN Applications, which may include but are not limited to attending and participating in public meetings, hearings, and other discussions on the CCN Applications, meeting, discussing and coordinating with other persons and entities that have similar interests in the matter; requesting a contested case hearing on the CCN Applications; and representing the City in proceedings on the CCN Applications before the Texas Commission on Environmental Quality and the State Office of Hearing Examiners. Part 4. The City Council hereby retains the services of the law firm of Tiemann, Shahady, and Hamala, P.C., P.O. Box 1190, Pflugerville, TX 78691-1190 (mailing address), 102 N. Railroad Ave. Pflugerville, TX 78660 (delivery address), to represent the City in a contested case hearing on this matter before the Texas Commission on Environmental Quality and the State Office of Hearing Examiners. Part 5: This Resolution, and all provisions contained herein, shall be effective immediately upon its passage. You are pro ably aware that the property is not located within the certificated service area of any !.rater or wastewater service provider The purpose of this letter is to request the inclusion of Garey Retch (the future Garey Park) into the City's ward and wastewater Amite territory. It would only make sense to have the City provide service to its futilre park in the same manner it provides service to its existing parks. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1. . The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Environmental and Resource Conservation End 3.0, which states: "The physical qualities that make Georgetown attractive area protected"; and 2. Growth and Physical Development End 7.2, which states: "Annexation procedures and standards benefit the communi and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan SECTION 2. The City Council of the City of Georgetown hereby adopts an annexation policy, attached as Exhibit A, to guide the planning and procedures for the annexation of territory into the City limits.
