HomeMy WebLinkAboutRES 030904-U - Property Tax ExemptionRESOLUTION NO. 0300 — 6t A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, DIRECTING STAFF TO PREPARE AN ORDINANCE AMENDING ORDINANCE 2004-16 REGARDING REINSTATING THE APPROVED PROPERTY TAX EXEMPTIONS SHOULD A PROPOSITION 13 ELECTION BE FAILED BY A MAJORITY OF THE VOTERS IN GEORGETOWN. WHEREAS, the City of Georgetown City Council adopted an ordinance on February 24, 2004, that establishes property tax exemptions for disabled persons and increases the property tax exemption for persons over the age of 65 years; and WHEREAS, Ordinance 2004-16 contains a sunset provision that states that the exemptions will automatically be repealed in their entirety (except for any minimum amounts that remain in effect as may be required by state law) without further action of the City Council, effective on the date that the City Council provides for a tax limit as authorized by Tex Const. Art. 8, Sec. 1-b(h), or on the date that the City Council calls or orders an election to consider approval of such a tax freeze, as applicable; and WHEREAS, the City Council wishes to enact an ordinance that will reinstate the tax exemptions, should an election on Proposition 13 be failed by a majonty of the voters in Georgetown. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element 1. Governmental Affairs Policy End 15.0, which states: "A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations." SECTION 2. Staff is hereby directed to prepare an ordinance for Council consideration at the March 22 2004 Council Meeting to officially reinstate the approved tax exemptions of $40,000 for disabled persons and $42 000 for persons over the age of 65 years, should an election on Proposition 13 be held and defeated by the voters of Georgetown.
