HomeMy WebLinkAboutRES 111104-B - Canvass Special ElectionCERTIFICATE FOR RESOLUTION NO. / / / 1 0 + ~ THE STATE OF TEXAS COUNTY OF WILLIAMSON CITY OF GEORGETOWN We, the undersigned officials of the City of Georgetown, Texas (the "County"), hereby certify as follows: 1. The City Council of the City convened in a SPECIAL MEETING ON THE 11 TH DAY OF NOVEMBER 2004, at the City Hall (the "Meeting'), and the roll was called of the duly constituted City Council Members of the City, to -wit: Gary Nelon, Mayor Doug Smith, Mayor Pro-Tem, Councilmember Dist. 3 Patty Eason, Councilmember Dist. 1 Gabe Sansing, Councilmember Dist. 2 Henry Carr, Councilmember Dist. 4 John Kirby Councilmember Dist. 5 Farley Snell, Councilmember Dist. 6 Ben Oliver, Councilmember Dist. 7 and all of the persons were present, except the following absentees:JP$ constituting a quorum. Whereupon, among other business, the following was Meeting: a written RESOLUTION CANVASSING ELECTION RETURNS , thus transacted at the was duly introduced for the consideration of the City Council. It was then duly moved and seconded that the Resolution be passed, and, after due discussion, said motion carrymg with it the passage of the Resolution, prevailed and carried by the following vote: AYES NOES 2. A true, full and correct copy of the Resolution passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate that the Resolution has been duly recorded in the City Council's minutes of the Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from the City Council's minutes of the Meeting pertaining to the passage of the Resolution that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting county officials as indicated therein; that each GTOWN2004: CANVASSRES.CRT of the elected officials and members of the City Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the Meeting, and that the Resolution would be introduced and considered for passage at the Meeting, and each of the elected officials and members consented, in advance, to the holding of the Meeting for such purpose, and that the Meeting was open to the public and public notice of the time, place and purpose of the meeting was given, all as required by Chapter 551, Government Code, as amended. 3. The Mayor of the City has approved and hereby approves the Resolution; that the Mayor and City Secretary of the City have duly signed the Resolution; and that the Mayor and City Secretary of the City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of the Resolution for all purposes. GTOWN2004: CANVASSRES.CRT SIGNED AND SEALED City Secretary [CITY SEAL] GTOWN2004: CANVASSRES.CRT • RESOLUTION NO. 11110 4 - 8 THE STATE OF TEXAS COUNTY OF WILLIAMSON CITY OF GEORGETOWN WHEREAS, the City Council of the City of Georgetown, Texas (the "City") ordered an election to be held in the City on November 2, 2004, on the three BOND PROPOSITIONS and one CIVIL SERVICE PROPOSITION hereinafter stated; and WHEREAS, the City Council has investigated all matters pertaining to the election, including the ordering, giving notice, officers, holding, and making returns of the election; and WHEREAS, the election officers who held the election have duly made the returns of the result thereof, and the returns have been duly delivered to this City Council. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: 1. The City Council officially finds and determines that the election was duly ordered, that proper notice of the election was duly given, that proper election officers were duly appointed prior to the election, that the election was duly held, that the City has complied with the Federal Voting Rights Act and the Texas Election Code, that due returns of the result of the election have been made and delivered, and that the City Council has duly canvassed the returns, all in accordance with law and the Resolution calling the election. 2. The City Council officially finds and determines that the following votes were cast at the election on the submitted BOND PROPOSITIONS by the resident, qualified electors of said City, who voted at said election. The City Council officially finds, determines and declares the result of the election to be that Propositions Nos. 1, 2, 3, and 4, so submitted have received a favorable majority vote in all respects and have carried. 4. The bonds set forth in Propositions Nos. 1, 2, and 3 may be issued, and the aforesaid bond taxes may be levied, assessed and collected annually, as voted and as provided by law.
