RES 121404-AA - St Sales Tax Elections
RESOLUTION NO. /41©4-14A A RESOLUTION TO REMOVE THE FOUR-YEAR SUNSET PROVISION FOR FUTURE STREET SALES TAX ELECTIONS WHEREAS, it is likely that the Texas Legislature will review the success of H.B. 445 approved by the 2001 Texas Legislature, and WHEREAS, H.B. 445 authorizes Texas municipalities to levy an additional 0.25 percent sales and use tax to support street repairs and maintenance: and WHEREAS, currently the above mentioned sales and use tax sunsets in four years; and WHEREAS, the City of Georgetown held an election in November 2002 and approved the additional 0.25 sales and use tax for maintenance on existing streets, and WHEREAS this sales tax stream provides the City of Georgetown with much -needed street maintenance funds, and WHEREAS during the upcoming legislative session the Texas Legislature, will consider the option of removing the four-year sunset provision for future street sales tax elections; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1: The City of Georgetown supports legislative efforts to remove the four- year sunset provision of H B 445 approved by the 2001 Texas Legislature for future street sales tax elections. SECTION 2. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policy of the Century Plan - Policy Plan Element: 1. Finance Policy End 14.0, which states: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided", /02/ti/o Qs 44 Pa -de I a- And further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Pohcies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan.
