HomeMy WebLinkAboutRES 040803-V-2 - Add Sect 7 Gtown PIDRESOLUTION MAKING CERTAIN FIN1 1 1 WITH THE PROPOSED ADDITION OF 50.38ACRES OF LAND (SECTIONOF THE GEORGETOWNPLANNED UNIT DEVELOPMENT :1 1 1 THE GEORGETOWN PLANNED UNIT DEVELOPMENTIMPROVEMENTDISTRICT RELATED TO THE ADVISABILITYOF THE IMPROVEMENTS, NATUREOF THE IMPROVEMENTS.,BOUNDARIES OF THE PROPOSED DISTRICT,11 OF ASSESSMENT AND THE APPORTIONMENT OF COSTDISTRICT AND THE CITY AS A V1if ir WHEREAS, pursuant to Chapter 372, Texas Local Government Code, a petition (the "Petition") was submitted to the City Secretary of the City of Georgetown, Texas (the "City") requesting to add 50.38 acres of land, generally described as Section 7 of the Georgetown. Village Planned Unit Development, to the Georgetown Village Planned Unit Development Pubic Improvement District (the "District"); and, WHEREAS, the Petition contained the signatures of owners of property representing more than fifty percent (50%) of the appraised value of the taxable real property liable for assessment with the proposed District and the signatures of property owners who own taxable real property that constitutes more than fifty percent (50%) of the area of all taxable real property that is liable for assessment under the Petition proposal, as well as the signatures of more than fifty percent (50%) of all record owners of property liable for assessment under the Petition proposal; and, WHEREAS, the Petition complied with the requirements of Chapter 372, Texas Local Government Code; and, WHEREAS, the public hearing was held with all interested parties having been given the opportunity to be heard; NOW, THEREFORE,BE 1 t BY THE CITY COUNCILOF THE CITY OF GEORGETOWN, Section 1. The City Council, having duly considered the Petition submitted by the property owner in the proposed District, and the comments and evidence of those who appeared at the public hearing on April 8, 2003, hereby makes the following findings: a. It is advisable to add 50.38 acres of land, known as Section 5 of the Georgetown Village Planned Unit Development to the District under the provisions of Chapter 372, Local Government Code. b. It is advisable that the City of Georgetown exercise the powers granted by Chapter 372, Local Government Code, in connection with the RESOLUTION NO. � � Adding Section 7 to GVPID#1 April 8, 2003 Page 1 of 4 establishment of the District, including authorizing the District to fund the maintenance of certain improvements within the District. C. It is advisable that the maintenance activities described herein be undertaken and provided in the District. d. The general nature of the proposed activities of the PID are to maintain the non -City parks, recreational facilities, alleyways, lighting, landscaping and related improvements located within the PID boundaries. The proposed assessments shall consist of a perpetual assessment for the administration and maintenance of park facilities, recreational facilities, landscaping, lighting, open spaces, pedestrian alleyways, signage and other related amenities, said maintenance assessment to supplement the normal city operations and maintenance of said park facilities, recreational facilities, landscaping, lighting, open spaces, pedestrian alleyways, signage, and other related amenities. e. The estimated annual cost for maintaining the non -City improvements within the PID for 2003 is $105,946, not including interest. f. The boundaries of the District are set forth in Exhibit A, attached hereto. g. The method of assessment shall be based upon the annual, assessed value of each lot. The assessment shall be $0.20 per $100 valuation. The assessment on each lot shall commence on January 1 of the first year after said lot is part of a final, recorded subdivision plat. h. The total costs of the maintenance of the non -City improvements shall be borne by the property owners within the PID. The City of Georgetown, Texas, shall incur no costs associated with the PID administration or construction, operation, or maintenance of any of the non -City improvements that are maintained by the PID. The apportionment of costs maintaining the non -City improvements between the District and the City, as a whole, is as follows: District - City as a Whole Resolution No. Adding Section 7 to GVPID#1 April 8, 2003 Page 2 of 4 100% 0% Section 2.
