RES 031103-L - Georgetown PID Hearing
RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF GEORGETOWN, TEXAS, SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE INCLUSION OF 50.38 ACRES OF REAL PROPERTY KNOWN AS SECTION 7 OF THE GEORGETOWN VILLAGE SUBDIVISION INTO THE GEORGETOWN VILLAGE PUBLIC IMPROVEMENT DISTRICT #1; AUTHORIZING PUBLICATION OF NOTICE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on February 23rd, 1999, the City adopted Resolution 99023-N, which created the Georgetown Village Public Improvement District #1, (the "District"); and WHEREAS, Shell Ranch Development, Inc., as owner of certain real property described in Exhibit "A", attached hereto and known as Section 7 of the Georgetown Village Subdivision (the "Property"), have filed a Petition for Inclusion of the Property within the Georgetown Village Public Improvement District #1; and WHEREAS, before including the Property within the District, the City must call a public hearing, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following Century Plan Elements: 1. Growth & Physical Development Policy 7.0 of the Century Plan - Policy Plan Element, which states: "Georgetown's land uses support economic, cultural and social activities for all residents, businesses and organizations; and the City's development process encourages new and infill development"; and 2. Finance Policy 5.0 of the Century Plan - Policy Plan Element, which states; "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both short-term and long-term needs are provided." Resolution No. 0 3 11 d 3 - Setting Hearing on Adding Section 7 into GVPID #1 Page 1 of 3 Pages and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. Pursuant to Section 372.009 of the Local Government Code, a public hearing regarding the inclusion of real property, as described in Exhibit 'A", into the Georgetown Village Public Improvement District No. 1 shall be held before the City Council of the City of Georgetown, Texas on the 8th day of April, 2003, at 6:00 p.m. at 300 Industrial Avenue, Georgetown, Texas. Notice of the public hearing shall be published before the 151h day before the date of the hearing, and notice must state: a, the time and place of the hearing; b, the general nature of the proposed improvements; c. the estimated cost of the improvements; d. the boundaries of the proposed assessment district; e. the proposed method of assessment; and f, the proposed apportionment of cost between the improvement district and the city as a whole. IV. Written notice of the hearing must also be mailed before the 151h day before the hearing to all owners of property subject to assessment.
