HomeMy WebLinkAboutRES 071304-Y - Amend RES Sepecial ElectionRESOLUTION NO. 07/ DY I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING RESOLUTION NO. 060804-N PERTAINING TO THE ORDERING OF A SPECIAL ELECTION ON SEPTEMBER 11, 2004, APPOINTING ELECTION OFFICIALS AND REVISING THE PROPOSITION AND BALLOT LANGUAGE. WHEREAS, on June 8, 2004, by resolution No. 060804-N, the City Council of the City of Georgetown, Texas called a Special Election for September 11, 2004, for the purpose of seeking voter response to a proposition providing: "that the total amount of ad valorem taxes imposed by the City of Georgetown, Texas on the homestead of a person who is disabled or is sixty-five (65) years of age or older may not be increased while it remains the residence homestead of that person or that person's spouse who is disabled or sixty-five (65) years of age or older, except for any increases that may be allowed by the Texas Tax Code, Section 11.261, as amended from time to time;" and WHEREAS, the City Council desires to amend Resolution No. 060804-N to appoint the election officials for said election and to revise the proposition and ballot language. NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1 - VERIFICATION OF FACTS The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council has found that this action implements Governmental Affairs Focus End 15.01 of the Century Plan - Policy Plan Element, which states: "All citizens. actively participate in governmental functions;" and has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2 - ELECTION OFFICIALS The Presiding and Alternate Presiding Judges for early voting and Election Day polling places shall be as stated on the attached Exhibit "A." SECTION 3 - PROPOSITION Section 6 of Resolution 060804-N is hereby amended to state that the following Proposition shall be submitted in accordance with law: Special Election Resolution No. (Amending Resolution No. 060804-N) Page 1 of 3 Pages Q-r PROPOSITION Establishment by the City of Georgetown, Texas of an ad valorem tax freeze on the residence homestead of a person who is disabled or sixty-five (65) years of age or older in accordance with Article VIII, Section 1-b(h) of the Texas Constitution and Section 11.261 of the Texas Tax Code, both as may be amended from time to time, (sometimes commonly referred to as "Proposition 13") including any increases that may be allowed by the Texas Constitution or the Texas Tax Code. SECTION 4 - OFFICIAL BALLOTS Section 6 of Resolution No. 060804-N is further amended to state that the official ballots for the election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR' or "AGAINST" the aforesaid proposition with the ballots to contain such provisions, markings, and language as required by law, and with such Proposition to be expressed substantially as follows: Proposition Establishment of an ad valorem tax freeze on the residence homestead of a person who is disabled or 65 years of age or older ("Proposition 13") FOR Against SECTION 5 - EFFECT OF AMENDMENT ON RESOLUTION NO. 060804-N Except as stated above, there are no other changes to Resolution No. 060804-N,_and all provisions of Resolution No. 060804-N that are not amended hereby shall remain in full force and effect. SECTION 6 - AUTHORIZATION TO EXECUTE The Mayor of the City of Georgetown is authorized to execute and the City Secretary is authorized to attest to this Order on behalf of the City Council; and the Mayor is further authorized to do all other things legal and necessary in connection with the holding and consummation of the Special Election.
