V 0 I 3 e A Resolution of the City Council of the City of Georgetown, Texas, granting a Petition for the Voluntary Annexation of 6.14 acres in the Powell Survey, for the Mercedes Benz expansion; and directing publication of notice and public hearings for proposed annexation Whereas, the owners of the hereinafter described area of land have requested the governing body of the City of Georgetown, pursuant to Local Government Code Section 43.028, by written petition, properly acknowledged, to annex said area of land into the City of Georgetown, to -wit: 6.14 acres in the Powell Survey, Williamson County, Texas, more particularly shown on the map attached hereto as Exhibit "A" and described by metes and bounds in Exhibit "B," both of which are attached hereto and incorporated herein by reference as if set forth in full; and Whereas, the said area of land is contiguous to the existing city limits of the City of Georgetown, and is vacant and without residents or has fewer than three qualified voters residing on it. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: That the said Petition, being proper and according to law, shall be, and is hereby, granted; and, further, the City Secretary is directed to commence the publication of notices of two public hearings to be held April 9, 2013 and April 23, 2013, before the City Council on the subject of the proposed annexation of the said area into the city limits; and further, to place upon the City Council Agendas for May 14, 2013, and any meeting before May 28, 2013, the consideration of the passage of an ordinance annexing said area into the city limits. Kelley Foundation BEING 6.14 acres of land, situated in the Ephraim Evans Survey, Abstract No. 212 and the John Powell Survey, Abstract No. 491, in Williamson County, Texas, said land being a portion of that certain tract of land, called 82.8658 acres, as conveyed to W.D. Kelley Foundation by deed recorded as Document No. 2002001129 of the Official Public Records of Williamson County, Texas. Surveyed on the ground in the month of April, 2013, under the supervision of Brian F. Peterson, Registered Professional Land Surveyor, and being more particularly described as follows; Beginning for reference at an iron pin set on the north line of Westinghouse Road (County Road No. 111) for the Northwest comer of that certain tract of land, called 0.209 of an acre, as conveyed to Williamson County, Texas, by deed recorded as Document No 2008008490 of the Official Public Records of Williamson County, Texas, and being on the east line of Kelley Drive, a dedicated roadway as shown on the plat of Kelley Trust Phases One, Two, and Three, a subdivision of record in Cabinet S, Slide 399, of the Plat Records of Williamson County, Texas. Thence, along the said east line of Kelley Drive, N 22°05'00" W, 441.76 feet to an iron pin found and N 22°00'30" W, passing the north line of the Ephraim Evans Survey, Abstract No. 212 and the south line of the John Powell Survey Abstract No. 491, for a total distance of 28.93 feet, in all, to a point on the City Limit of the City of Georgetown, Texas, for the Southwest corner and Point of BEGINNING hereof, THENCE, along the said east line of Kelley Drive N 22°00'30" W, 136.89 feet, to an iron pin found at the beginning of a curve to the right, (Radius = 970.00 feet, Long Chord bears N 15°58'30" W, 203.90 feet); Thence, along the said curve for an arc distance of 204.28 feet to an iron pin found; Thence, N 9°59 30" W, 324.15 feet to an iron pin set for the Northwest corner hereof; from said point an iron pin found bears N 9°59'30" W, 64.43 feet; THENCE, N 79°22'00" E, 412.68 feet to an iron pin set an, or near, the east line of the John Powell Survey, Abstract No. 491, being the west line of the Francis A. Hudson Survey, Abstract No. 295, being an easterly line of the said 82.8658 acre W.D. Kelley Foundation tract, being the west line of that certain tract of land, called 55.41 acres, as conveyed to Carrie Ann Barton Smith by deed recorded as Document No. 2004049997 of the Official Public Records of Williamson County, Texas, for the Northeast corner hereof; from said point an iron pin found bears N 21°53'45" W, 183.38 feet; THENCE, along, or near, the said east line of the John Powell Survey, Abstract No. 491, being the said west line of the Francis A. Hudson Survey, Abstract No. 295, S 21°53'45" E 242 55 feet to an iron pin found for a southeasterly comer of the said 82.8658 acre W.D. Kelley Foundation tract, being an interior corner of the said 55.41 acre Smith tract, for the most northerly Southeast corner hereof; Exhibit B THENCE, S 66°36'30' W, 63.19 feet to an iron pin found marking an interior comer of the said 82.8658 acre W.D. Kelley Foundation tract, being a northwesterly corner of the said 55.41 acre Smith tract, for an interior corner hereof; THENCE, along an easterly line of the said 82.8658 acre W.D. Kelley Foundation tract, being a westerly line of the said 55.41 acre Smith tract, S 21 ° 11'45" E, 256.53 feet to an iron pin found and S 20°49'45' E, 76.97 feet to a point on the said City Limit of the City of Georgetown, Texas, for the Southeast comer hereof, THENCE, along the said City Limit of the City of Georgetown, Texas, S 67°47°45° W, 110.04 feet to a point and S 68°27'46" W, 314.58 feet to the Place of BEGINNING and containing 6.14 acres of land.
