III A Resolution of the City Council of the City of Georgetown, Texas, announcing that the City's population has surpassed 50,000 residents and acknowledging the extension of the City's Extraterritorial Jurisdiction to 3.5 miles. WHEREAS, Section 42 of the Texas Local Government Code establishes the purpose and extent of designated Extraterritorial Jurisdiction (ETJ) for municipalities and WHEREAS, Section 42 022 of the Texas Local Government Code allows for the expansion of a municipality's ETJ through an increase in the number of inhabitants; and WHEREAS, The U.S. Census 2010 declared the City of Georgetown population to be 47,400 residents as of April 1, 2010; and WHEREAS, Georgetown has experienced continuous population growth within its corporate limits since April 2010, and WHEREAS, City of Georgetown staff use Census baseline population data, average Household Size, population increase through annexation, and building permits for single- family and multi -family residential units to calculate population post -Census on a monthly basis; and WHEREAS, City of Georgetown staff calculate the population within the corporate limits as of September 1, 2012, to be 50,019 residents; and WHEREAS, Section 42.012 of the Texas Local Government Code establishes the extent of an ETJ for municipalities with 50,000 to 99,999 inhabitants to be 3-1/2 miles; and WHEREAS, the City Council finds that it is in the best interest of the city and its citizens to promote and protect the general health, safety, and welfare of persons residing in and adjacent to the city limits of Georgetown. Now, Therefore, be it resolved by the City Council of the City of Georgetown, Texas, that: SECTION 1: The foregoing recitals are hereby found to be true and correct and are incorporated herein by reference for all purposes. SECTION 2• The City of Georgetown hereby ackowledges that the increase in inhabitants within the City's corporate limits has surpassed the 50,000 threshold, and Resolution Number: "� r""� �a Page 1 of 2 Description: 50,000 population declaration Date Approved: September 11, 2012 recognizes the corresponding statutory extension of the City's ETJ boundaries to 3-1/2 miles where said extension is not previously restricted by agreement with a neighboring municipality or other action taken by this City Council. SECTION 3: If any provisions of this Resolution or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Resolution which can be given effect without the invalid provision or application and to this end the provisions of this Resolution are hereby declared to be severable. SECTION 4: The said ETJ extension being proper and according to law, the Mayor of Georgetown is hereby authorized to sign this Resolution and the City Secretary to. attest. this Resolution shall become effective on the date of its approval by the Georgetown City Council.
