HomeMy WebLinkAboutRES 092512-L - Contract TXDPS Drivers LicenseDate Approved• RESOLUTION NO. 51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AUTHORIZING THE CITY OF GEORGETOWN TO ENTER INTO A NEW INTERLOCAL COOPERATION CONTRACT WITH THE TEXAS DEPARTMENT OF PUBLIC SAFETY (TDPS) FOR THE PURPOSE OF PROVIDING INFORMATION NECESSARY TO DENY THE RENEWAL OF A DRIVER LICENSE. WHFRF AS, pursuant to the existing Interlocal Cooperation Contract, the City of Georgetow❑ has permission to provide information necessary to deny renewal of the driver license of a person who fails to appear• for a complaint or citation or fails to pay or satisfy a judgment ordering payment of a fine or cost in the manner ordered by the court ina matter involving any offense that a court has jurisdiction of under Chapter 4, Code of Criminal Procedure; and WHL,RF•,AS, currently the City is required to notify the Texas Department of Public safety within five business days when no cause exists to continue to deny renewal of a person's driver license; and WHEREAS, the 82nd Texas Legislature Session, amended Section 706.005 requiring courts to report compliance immediately; and WHERE' AS, as a result of the statutory change, a new Interlocal Cooperation Contract is required that reflects the obligation to report compliance immediately; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TF,XAS, THAT SECTION 1. The City Council of the City of Georgetown hereby agrees to enter into a new Interlocal Cooperation Contract with the Texas Department of Public Safety attached and authorizes the Mayor to sign the Interlocal Cooperation Contract on its behalf.
