HomeMy WebLinkAboutORD 2000-20 - Disannexation of EmbreeAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, PROVIDING FOR THE AMENDMENT OF CERTAIN BOUNDARY LIMITS OF THE CITY OF GEORGETOWN, TEXAS, AND THE DISANNEXATION OF CERTAIN TERRITORY DESCRIBED AS LOTS 14, EMBREE SUBDIVISION, AS RECORDED IN CABINET P, SLIDE 272, PLAT RECORDS, WILLIAMSON COUNTY, TEXAS, LOCATED WEST OF STATE HIGHWAY 195 AND NORTH OF COUNTY ROAD 190; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, may under Section 1.06 of the City Charter, disannex areas as allowed by State law; WHEREAS, the Council wishes to disannex the herein described property, which was annexed by Ordinance No. 96-53 on December 10, 1996; and WHEREAS, no utility services have been provided to the property or are anticipated to be needed by the property owner within the next five years. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following Century Plan - Policy Plan Elements: • Growth and Physical Development Focus End 3.00 -- "Citizens, business owners and organizations enjoy the benefits of well-planned land usage in which conflicting needs are balanced"; and • Environmental and Resource Conservation Policy End 2.00 -- "Georgetown's natural and physical resources are managed so that citizens enjoy the benefits of economic and social development"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, Ordinance No. 0?6100 ° aw Disannexation of Embree Subdivision Page 1 of 2 SECTION 2. The City Council of the City of Georgetown hereby disannexes Lots 1-4, Embree Subdivision, as recorded in Cabinet P, Slide 272, Plat Records, Williamson County, Texas, consisting of approximately 9.023 acres in the John Berry Survey, located west of State Highway 195 and north of County Road 190; Lots 1-3 being owned by YAAB Investments, L.P., and Lot 4 being owned by The CKJ Investment Trust, John Gustainis, Trustee. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. t PASSED AND APPROVED on First Reading on the 1.1h(day of PASSED AND APPROVED on Second Reading on the cO day of /, 2000.
