HomeMy WebLinkAboutORD 93-25 - Rabies ControlORDINANCE No. q3� 2 WHEREAS, The Rabies Control Act of 1981, Texas Health and Safety Code, Annotated Section 826.015 and Section 826.017 (Vernon 1992) authorizes the establishment of rules to control rabies and to designate a local health authority; and, WHEREAS, the City Council of the City of Georgetown, Texas, finds that it is in the interest of public health and safety to amend its ordinance related to rabies control and to designate a local health authority for rabies control; and, iij!''I I• - Section 1 The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Health and Human Services Policy 1 of the Century Plan - Policy Plan Element which states, "The City will cooperate with public and private health and human services related organizations to assure that there are comprehensive services available" and is not found to be inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; Section 2 The attached Exhibit "A", relating to Rabies Control is hereby adopted by the City Council of the City of Georgetown, Texas, ORDINANCE No. Revision to Rabies Control Ordinance No. 7.12 Georgetown Municipal Code Page 1 of 2 Section 3 All ordinances • resolutions,or parts of ordinances and resolutions,Ordinance hereby-.-. -r and are no longer of • - and effect, Section 4 If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 5 The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. The owner of any dog or other animal affected or suspected of being affected with the disease of rabies, or any dog or other animal which has been bitten by any dog or other animal having rabies or suspected of having the same, shall immediately notify the to and firmly secure such dog or other animal as provided in Section 7.08.080. Any stray dog or other rabies -susceptible animal, the owner of which is unknown, where there is reasonable grounds for belief that such dog or other animal has rabies, or has been exposed to rabies, that may be found running at large is declared to be a nuisance and menace, and it shall be lawful to kill such dog or other animal without any notice or any order that such dog or other animal be confined; provided, further, it shall be lawful to kill any such dog or other animal that has bitten a person, within ten days after such dog or other animal has bitten such person, that may be found running at large, whether the owner thereof be known or not, and without any notice to the owner thereof.
