WHEREAS, the Texas Department of Transportation recently conducted speed studies on State Highway 29 (University Blvd.) through the City of Georgetown; and WHEREAS, these studies indicate that certain speed limit adjustments within the existing speed zone are warranted at this time; and WHEREAS, the City Council of the City of Georgetown, Texas, by previous Ordinance No. 93-23 established modifications to speed limits in the area along certain portions of State Highway 29 (University Blvd.): and WHEREAS, the Texas Department of Transportation has notified the City that the only modifications that could be made were to extend the 35 mph zone just to the east of Maple Street, as hereinafter described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITI OF GEORGETOWN9 TEXASTHAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Transportation Policy 1 of the Century Plan - Policy Plan Element, which states: "The City will encourage a transportation system that provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the personal needs of individuals", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Sections 2.A.4, 2.A.5, 2.13.3, and 2.13.4 of Ordinance 93.23 in Section 10.12.020 of the Code of Ordinances of the City of Georgetown, Texas is hereby amended to read as follows: Modified Hwy. 29 Speed Limit Ordinance No. t Page 1 of 2 Pages . From milepooint 22.779 to milepoint 22.366 22.411, a distance of 0.368 miles, a prima facie maximum speed limit of 40 miles per hour. . From milepoint 22.366 22.411 to milepoint 11.600, a distance of 1.015 1.060 miles, a prima facie maximum speed limit of 35 miles per hour, SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application of it to any person or circumstance, is held to be invalid, the remainder of the ordinance which can be given effect without the invalid provision or application shall applied as valid and is hereby declared to be severable from the invalid portion. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest.
