HomeMy WebLinkAboutRES 081313-V - DisANX Mott SurveyRESOLUTION NO. 0 3 'v A Resolution of the City Council of the City of Georgetown, Texas, granting a Petition for the Disannexation of 28.4 acres in the Mott Survey from the city limits; and directing publication of notice and public hearings for proposed disannexation WHEREAS, Section 43 142 of the Texas Local Government Code allows municipalities to disannex an area of land within the defined corporate limits according to the city's charter; and WHEREAS, Section 1.06 of the City of Georgetown Code of Ordinances grants the City Council power to disannex upon the written petition of landowners within said area; and WHEREAS, the owners of the hereinafter described area of land have requested the. governing body of the City of Georgetown, pursuant to Local Government Code Section 43.142, by written petition, properly acknowledged, to disannex said area of land from the City of Georgetown corporate limits, to -wit: 28.4 acres, more or less, in the Mott Survey, Williamson County, Texas, more particularly shown on the map attached hereto as Exhibit "A" and described by metes and bounds in Exhibit "B " both of which are attached hereto and incorporated herein by reference as if set forth in full; and WHEREAS, the owners of saidarea of land are seeking disannexation so as to build a cohesive development within the City of Round Rock's corporate limits and not for a failure of the City of Georgetown to provide services according to the approved service plans; and WHEREAS the City of Georgetown, City of Round Rock, and said property owners are working in good faith together to facilitate the disannexation while continuing to discuss terms of a future agreement; and WHEREAS, it is in the interest of both municipalities and property owners to resolve the issue of utility provision, transportation planning, and a unified set of development standards in order to facilitate a planned development; and WHEREAS, saidfuture agreement will also contemplate the release of said area of land plus additional territory from the City of Georgetown's extra -territorial jurisdiction for inclusion into the City of Round Rock's extra -territorial jurisdiction. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: That the said Petition for disannexation, being proper and according to law, shall be, and is hereby, granted; and, further,lthe City Secretary is directed to commence the publication of notices Resolution No. ©Q©©1 13 - V%Page 1 of 2 Avery-Greinert-Taylor Morrison Disannexation Date Approved: 8.6.2013 of two public hearings to be held October 8, 2013 and October 22, 2013, before the City Council on the subject of the proposed disannexation of the said area from the city limits; and further, to place upon the City Council Agendas for November 12, 2013, and any subsequent public meeting before January 28, 2014, the consideration of the passage of an ordinance disannexing said area from the city limits. That the Cities of Round Rock and Georgetown and property owners will work to craft an agreement, prior to November 26, 2013, that will address, but may not be limited to: 1) Disannexation of approximately 94 acres of territory from the City of Georgetown's extra- territorial jurisdiction. 2) Amendment of the approved boundary agreement line between Georgetown and Round Rock. 3) Provisions for utility service to the property. 4) Preservation of the former MoKan rail corridor right-of-way directly south of the Georgetown border. 5) Donation of right-of-way for Westinghouse Road expansion and potential for future Traffic Impact Analysis considerations.
