Building Standards Commission

A regular meeting of the Building Standards Commission, for consideration and possible action on the following:
Meeting called to order at 4:00 pm
Regular Session
1. Consideration of approval of the minutes from the regular Commission meeting held on
July 20, 2006 and August 3, 2006.
Motioned by Ed Martin to approve the July 20, 2006 and August 3, 2006 minutes. Seconded by
Stanley Bland. Motion approved 5-0.
Executive Session
(Commission reserves the right to convene into Executive Session at any time during the meeting
regarding any agenda item. In compliance with the Open Meetings Act, Chapter 551 Government
Code, Vernon’s Texas Code, Annotated, the item below will be discussed in closed session.)
2. Section 551.071 consultation with attorney. None

3. Action from Executive Session. None
4. Discussion and possible action for a variance request to the 2003 International Fire
Code, specifically Section 610.2 pertaining to Commercial Kitchen Hoods for
commercial and domestic cooking appliances for a new school project by Community
Montessori School to be located at 500 Pleasant Valley Drive, Lot 1 in Hartman Acres.
Karalei Nunn from 1113 Architects and Rebecca Lowe from Community Montessori School were
present to request variance to code. Section 610.2 was discussed by Dave Hall. He explained Fire
Code Examiners findings during review.
Dave stated that existing buildings were built to the 1994 Building Code that did not require the
correct hood system. Former incidents have created the code changes to be made.
Karalei Nunn stated that the use of these kitchens provided would be used for light cooking and
heating children’s lunches only. She stated that the code specifically says it is for frying or heavy
cooking which is not the use at this building or any other locations the school has. She stated that
this is the sixth building to have this same kitchen and have had no previous problems during use.
She also stated that they use the oven to heat the food to avoid using the stovetop mostly.
Fire staff Don Jansen stated that the fire alarm system is a manual system which will have not
have a smoke detector located in the kitchen and is more than adequate for the children.
Commissioner Baxter questioned the term Commercial Kitchen and the exact definition.
Commissioner Becky Krause questioned if there would be annual inspections to prevent changes
being made without examination. Members stated that a variance would allow the staff to cook
whatever they wanted at any time and the yearly inspection done by the fire inspector is to only
check out the building and not activity within the building on a daily basis.
Lenning will provide finding of facts for Dave. Commissioner Riki Young stated that he does not vote
for any of the variances and that he feels the code states this issue very clear. Commissioner Baxter
stated that the code does allow interpretation which the old code did not have and that stated that it
was a majority of opinion that agreed.
5. Discussion and possible action for a variance request to the 2003 International Mechanical Code,
specifically Section 507.2.3 pertaining to Commercial Kitchen Hoods and specifically Domestic
cooking appliances used for commercial purposes for a new school project by Community
Montessori School to be located at 500 Pleasant Valley Drive, Lot 1 in Hartman Acres.
Discussed in item 4.
6. Discussion and possible action for a variance request to the 2003 International Plumbing Code,
specifically Section 1003.3.1 pertaining to Interceptors and Separators and specifically Grease
traps and grease interceptors required for a new school project by Community Montessori School
to be located at 500 Pleasant Valley Drive, Lot 1 in Hartman Acres.
Discussed in item 4.
7. Suggested items for next regularly scheduled meeting agenda.
Dave stated it was time for the 2006 International Building Code and the 2007 International
Residential Code to be adopted.
Dave also discussed that the City has a new Chief Code Enforcement Officer which has some
Dangerous Structures to be discussed on upcoming meetings.
