(5-0) 3.Public Hearing and possible action on a Special Exception for a setback modification to allow an accessory structure to encroach 5’ into the rear setback, for Spark’s Addition, Block 6, Lot 3, located at 2006 S. Main Street. (RW) SE-2011-002 Staff report by Robbie Wyler. The applicant is requesting Special Exception approval for a setback modification from the Zoning Board of Adjustment (ZBA) to allow a 16’ x 16’ accessory structure to encroach into the rear yard setback. The property is used as a residence and includes a main dwelling and detached garage. The subject structure was brought to the City’s attention when complaints were submitted regarding its construction. The following is a time-line history on the development of the structure: ·04/08/11: Georgetown’s Code Enforcement department responded to a complaint that a building was under construction in the backyard of 2006 S. Main Street. Permitting records showed no permit was issued for the project. A door tag was left at the property stating there was a code violation and to stop construction until a permit has been approved and issued. Later that day the property owner, Mr. Stephens, stopped by the Permitting office to discuss the notice. After further discussion, the property owner submitted materials for a building permit. ·04/20/11: A building permit was issued for the structure. At this point, the structure was not completed. ·05/20/11: The structure was completed. Upon inspection of the property, its appeared the location of the structure was not consistent with the issued permit. Code Enforcement met with the property owner to discuss this matter. ·05/26/11: It was determined the plans provided for the permit did not match what was built on site and that the structure was encroaching into the setback. Code Enforcement spoke with Mr. Stephens and discussed options to bring the structure into compliance including moving it away from the rear property line, reducing the height or receiving Special Exception approval from ZBA. ·06/02/11: A meeting was held with Mr. Stephens and staff. After further discussion on the options for the structure, the property owner chose to apply for a Special Exception request. ·07/14/11: An application for a Special Exception for Setback Modification was received and accepted in the Planning department and the request was set for the August 16, 2011 ZBA meeting. The applicant started construction of the accessory building prior to receiving the required permits. When the building permits were eventually issued, the applicant had already commenced with finishing the structure and upon final inspection by the Building Inspector, did not build the structure as detailed on the permit. Staff recommendeds denial of the Special Exception for Setback Modification to allow the 16’ x 16’ accessory structure in the rear setback. Chair Facey invited the applicant to speak. Bob Stephens, 2006 S. Main Street, stated 15 copies of his proposal wereas given to staff for review. He commended staff for their work in regard to this matter. He stated the structure matches the house isand not in the Historic Overlay District and noted all property behind him belongs to Mr. Pope, who is not opposed to his building. He said there was not a complaint filed and the building is built according to the National Electric Code. His building cost him over $6,000. He did know there was a 10 foot setback requirementit oo, but the building was already built. His builder thought it was a 5 foot set back. Mr. Stephens stated the 10 foot setback needs to be reviewed. Chair Facey opened the Public Hearing, no one came forward, and the Public Hearing was closed. Motion by Elliot for denial of the Special Exception for Setback Modification to allow the 16’ x 16’ accessory structure in the rear setback located at 2006 S. Main Street due to the request being solely a matter of convenience and that there is adequate room on the site to allow the proposed addition. Second by Sensabaugh. Approved. The applicant is requesting Special Exception approval from the Zoning Board of Adjustment (ZBA) to expand/enlarge a legal nonconforming use by placing one (1) additional modular structure on the property for use as an Art and Music classroom for the Academy. The property has been developed as a private academic use with six (6) modular buildings and a parking lot for 48 vehicles. Staff stated in the past, modular classroom buildings – which have officially been named ‘portable classrooms’ – were regulated inconsistently throughout the City. During the most recent comprehensive revision to the Unified Development Code (UDC), this use became more stringently regulated, and was better defined with the following definition: “Classroom, Portable – A classroom(s) located within a building constructed off-site and placed at an education facility on a temporary basis as permitted in Section 5.08 of this Code.” Staff finds that there will be no adverse impacts on the public interest or the spirit of the UDC. Had the site plan not expired, the applicant would be permitted to place this, and one additional, modular building on the property. Staff considers the Special Exception request appropriate and recommends approval. Chair Facey invited the applicant to speak. Randy Adaire, Grace Academy, stated Grace Academy has experienced growth in the past several years that requires another building. He stated staff presented their application request very well and “thanked” staff for their professionalism. Chair Facey opened the Public Hearing. No one came forward, the Public Hearing was closed. Second by Elliott as amended. Approved. (5-0) 4.Training and discussion regarding the purpose and responsibilities of the Zoning Board of Adjustment. Staff report by Valerie Kreger. The Zoning Board of Adjustment (ZBA) is on of two citizen staffed legislatively created bodies involved in municipal zoning (Planning and Zoning Commission is the other body). Then ZBA is a Board of action and deals with individual and neighborhood decisions on a tract-by-tract basis. The board acts in a quasi-judicial capacity, meaning is has powers resembling those of a court of law or judge. Appeal of any action of the ZBA must be made to a court of law. Ms. Kreger reviewed over the different types of applications and the steps staff takes before presenting the application to the Zoning Board of Adjustment. Ms. Kreger also reviewed over the presented staff report which includes Quorum Requirements, Voting, Appeals, Variances, and Standards for Granting Variances, Unnecessary Hardship, Special Exception, and the Role of Being a member of the Zoning Board of Adjustments. Board member Davis asked to clarify how the Board will determine “self-imposed or self-created” application. Bridget Chapman, Acting City Attorney stated the Board should rely on staff in gathering information and investigating to better inform the Board to assist with making a decision. Elizabeth Cook, Community Development Director, encouraged the Board to contact staff if they have any questions regarding the application. There was a discussion regarding a past variance application. 5.Consideration and possible action to amend the Zoning Board of Adjustment Bylaws. The City Council has recently adopted amended bylaws May 10, 2001 for all City’s boards and commissions, which make most provisions uniform for all groups. As part of that process, the Board is being asked to approve the Zoning Board of Adjustment bylaws as adopted by the Council. Bridget Chapman, Acting City Attorney stated these amendments were a result of process that was given by the City Managers office had requested the City Legal department to work with the City Secretary’s office to review the bylaws of the varies Boards and Committees and to make sure the Bylaws corresponded and did not conflict with the Ordinances along with making sure it is consistent with other City Boards and Commissions Bylaws. Ms. Chapman reviewed over each Article of the Zoning Board of Adjustment Bylaws approved by City Council. Motion by Elliott to approved the amended bylaws as presented. Second by Crawford. Approved. Approved (4-0) 3.Public Hearing and possible action on a Variance to Section 6.05.020.C of the Unified Development Code (UDC) to allow a building in the setbacks at Heritage Oaks, Section 4B, Block 1, Lot 51, located at 5132 Hidden Springs Trail.(VAR-2010-005) CB Staff report given by Carla Benton. The property owner is requesting a Variance from the Zoning Board of Adjustment to permit a building to encroach approximately 13’8” into a platted 20-foot rear setback. Section 06.05.020.C of the UDC (Features Allowed Within Required Setbacks), does not provide an allowance for buildings within the setbacks. The applicant is requesting variance to the setback based on the unusual configuration of the lot and the fact that the lot backs up against a platted drainage/open space lot, so that no residential lot to the rear will be impacted. The current rear setback for residential lots in the UDC is ten (10) feet. The platted rear setback for Heritage Oaks is 20 feet. Benton states that the purpose for setbacks is to ensure appropriate separation between uses. For residential properties, setbacks provide fire protection between buildings, aesthetic benefits of open or green space and a sense of privacy. In general, lots are designed in double blocks with residential lots backing up to other residential lots. The requested variance is to a rear setback for a lot that does not have a residential lot to the rear and the typical purposes of the setback is provided by the open space/drainage lot located along the rear. The proposed residence is to be 20 feet from the rear property line on the longest side of the lot, meeting the 20-foot setback if the lot had been a typical rectangular shaped lot. The residence also meets the front 20-foot setback, being 42 feet from the front property line at it’s farthest point. Therefore, if the lot had been of rectangular shape there would have been an additional 22 feet plus of additional area for locating the house within the proper setbacks. The reconfiguration from the typical rectangular shape for this lot at opposite corners, being the front for the cul-de-bubble and the rear for the drainage/open space lot, have created an unusual condition under which they are attempting to build. Changes in the UDC have removed the option for requesting the current UDC setback standards over the older previously platted setbacks. The rear setback for residential lots in the UDC is ten (10) feet and the platted rear setback for Heritage Oaks is 20 feet, in which case, the applicant still would be requesting a variance for the additional 3’8”. The lot consists of 8,346 square feet (s.f.) and the footprint (including garage) space of the proposed residence is 3,447 s.f. The maximum rectangular footprint that could be accommodated on this lot is approximately 2,700 s.f. (including garage). Benton concluded that staff does not recommend approval on the Variance. Applicant Alan Petty with Jimmy Jacobs Custom Homes stated that owners Renee Transou and Janet Zajicek found a lot to purchase in Georgetown to build their dream home on. Although a variance to the setback of the property was granted by the Heritage Oaks Neighborhood Association, the City requirement for a variance was learned while requesting a building permit.
