HomeMy WebLinkAboutORD 2014-01 - Austin Ave Speed ZoneORDINANCE • AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS, ZONING FOR TRAFFIC AND RATE OF SPEED THEREIN, ON AUSTIN AVENUE IN THE CITY LIMITS OF THE CITY OF GEORGETOWN BETWEEN LEANDER ROAD (RM 2243)/FM 1460 AND WILLIAMS DRIVE (SS 158) DEFINING SPEEDING AND FIXING A PENALTY THEREFOR; DECLARING WHAT MAY BE A SUFFICIENT COMPLAINT IN PROSECUTIONS HEREUNDER; WITH A SAVING CLAUSE REPEALING CONFLICTING LAWS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City's Transportation Services Department has determined upon the basis of an Engineering and Traffic investigation that the prima facie maximum speed limit on Austin Avenue routed within the corporate limits of Georgetown, between Leander Road (RM 2243)/FM 1460 and Williams Drive (SS 158), should be declared and signed indicating the prima facie maximum speed limit; and WHEREAS, the City Council of the City of Georgetown finds it to be in the best interest of the citizens of Georgetown to adopt the speed zones set out herein within the corporate limits of the City of Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GEORGETOWN: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following Vision Statements, Goals and Policies of the 2030 Comprehensive Plan: 3.0 Balanced Transportation /Efficient Mobility A. Georgetown has implemented improvements to the local road and traffic control system, including new thoroughfare linkages to enhance connectivity, improved and coordinated traffic signalization, and standards for access management to enhance traffic flow and safety. SECTION 2. New Section 10.12.082 of the City of Georgetown Code of Ordinances is hereby adopted and shall provide as follows: Section 10.12.082 Austin Avenue Ordinance No. rZO " Austin Avenue Speed Zone (January 14, 2014) Page 1 of 3 It is hereby determined upon the basis of an engineering and traffic investigation that the prima facie maximum speed limit(s) on those portions of Austin Avenue routed in the corporate limits of the City of Georgetown is hereby stated as follows, which prima facie maximum speed limit(s) shall be effective at all times and signs will be erected giving notice of the prima facie maximum speed limit so declared to wit: A. SPEED ZONE For both directions of traffic: 1. Beginning at the north edge of pavement of Leander Road (RM 2243)/FM 1460 to the centerline of 18th Street, west of Austin Avenue, a distance of 1,895 feet, a prima facie maximum speed limit of 40 miles per hour. 2. From the centerline of W. 181h Street to 570 feet north of 161h Street, a distance of 1,447 feet, a prima facie maximum speed limit of 35 miles per hour. 3. From 570 feet north of 161h Street to the centerline of 2nd Street, a distance of 3,605 feet, a prima facie maximum speed limit of 30 mph. 4. From the centerline 2nd Street to the south edge of the pavement for Williams Drive (SS 158), a distance of 2,664 feet, a prima facie maximum speed limit of 35 mph. B. That all of the streets of this city, and all portions of any such streets, are hereby declared to be public streets and that the driving or operating of any motor vehicle on or along any portion of any street of this city at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this ordinance shall be guilty of a misdemeanor, which is named "The Offense of Speeding" and that the said offense is punishable by a fine in any sum not to exceed two hundred dollars ($200.00). That the use of the word "Speeding" shall be sufficient to designate the said offense, and shall mean that a motor vehicle has been driven upon a public street at a greater rate of speed than fixed by City Ordinance for the street and for the zone thereof, that such motor vehicle was so being driven upon, if zoned. C. That in prosecutions under this ordinance, for the offense of speeding, the complaint, if in other respects sufficient in form, shall as to the portion thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that the defendant did while driving a motor vehicle in said city commit the offense of "Speeding." All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown.
