HomeMy WebLinkAboutRES 990223-N - Establish Gtown Village PIDRESOLUTION NO.� " •- • A .. •- • ..• ! • ! i .. • ! rlll WHEREAS, Chapter 372 of the Texas Local Government Code (the "Act ") authorizes the City of Georgetown ( "City ") to create public improvement districts; and WHEREAS, on September 15, 1998, owners of real property located in the City submitted a Petition for Establishment of Georgetown Village Public Improvement District #1 (the "District "), the boundaries of which are fully described by metes and bounds in Exhibit "A" attached hereto; and WHEREAS, after providing all notices required by the Act, the City Council of the City of Georgetown, on February 9, 1999, conducted a public hearing on the advisability of the improvements and the creation of the District. NOW, THEREFORE, • ! BY THE CITY COUNCIL OF OF i ` i SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following Centur Plan Elements: Growth & Physical Development Policy 7.0 of the Century Plan - Policy Plan Element, which states: "Georgetown's land uses support economic, cultural and social activities for all residents, businesses and organizations; and the City's development process encourages new and infill development "; and Finance Policy 5.0 of the Century Plan - Policy Plan Element, which states: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both short -term and long -term needs are provided. "; and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City Council of the City of Georgetown hereby makes the following findings and declarations regarding the Georgetown Village Public Improvement District No. 1: Resolution No. 9f02-713_1V Establishment of Georgetown Village Public Improvement District No. 1 Page 1 of 2 a. It is advisable to make the improvements as set forth in Exhibit "B" attached hereto, as the same will benefit the land within the District; b. The nature of the improvements are the acquisition, construction, operation, repair and maintenance of parks, recreational facilities, alleyways, lighting, landscaping and related improvements; C. The estimated annual cost of the improvements is $60,350.00, as shown on Exhibit "B"; d. The method of assessment shall be based upon the annual, assessed value of each lot within the District. The proposed assessment shall be $0.20 per $100.00 of valuation. A one-time Capital Improvement Assessment of $1,000.00 per lot is payable in full upon recordation of the final subdivision plat. e. The total costs of the operation, maintenance and construction of the improvements shall be borne by the District property owners. The City of Georgetown, Texas shall incur no costs associated with the District. SECTION 3. The Georgetown Public Improvement District No. 1 is hereby authorized and established as provided by the Act and in accordance with the findings in Section 2 above. SECTION 4. This resolution shall be effective upon publication pursuant to Chapter 372.010(b) of the Texas Local Government Code. RESOLVED this day of February, 1999.
