V? • • • = i i i • i i + + ! • WHEREAS, officials of Williamson County have discussed for several years the desire to construct an exposition center in Williamson County; and WHEREAS, the Georgetown City Council has expressed the desire to work with the County in locating the exposition center in Georgetown; and WHEREAS, there are potentially a number of alternatives which would provide for such a facility; and WHEREAS, the greatest opportunity for Williamson County and one of the municipalities within Williamson County is to construct such a facility as have a wide range of options available to them. NOW, THEREFORE, • • OF OF •- • SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element: 1. Economic Development Focus End 1.11, which states: "The tourism industry in Georgetown is developed and promoted, while preserving the community's small -town charm. "; and 2. Governmental Affairs Focus End 6.2, which states: "The city develops and coordinates service delivery policies with Williamson County, the Georgetown Independent School District and other organizations that provide services to Georgetown." SECTION 2. The Georgetown City Council hereby endorses the filing of legislation to permit the joint development and operation of an exposition center, as outlined in the proposed bill marked as Exhibit A. SECTION 3. The Georgetown City Council authorizes the staff to forward this resolution to Senator Steve Ogden, Senator Jeff Wentworth, and Representative Mike Exposition Center Resolution No. Page 1 of 2 Krusee with the request that they introduce and seek passage of this legislation for the benefit of Williamson County and cities within Williamson County. SECTION 4. The Mayor is hereby authorized to execute, and the City Secretary to attest thereto this resolution on behalf of the City of Georgetown. SECTION 5. No. 1 AN ACT 2 relating to authorizing counties and municipalities to jointly 3 establish certain recreational and cultural facilities. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. The heading of Chapter 301, Local Government 6 Code, is amended to read as follows: 7 CHAPTER 301. RECREATIONAL AND CULTURAL FACILITIES [AHH3T8R1-HMS] 8 JOINTLY ESTABLISHED BY COUNTIES AND MUNICIPALITIES 9 SECTION 2. Sections 301.001 - 301.003 and 301.006 - 301.008, 10 Local Government Code, are amended to read as follows: 11 Sec. 301.001. AUTHORITY TO ESTABLISH RECREATIONAL OR 12 CULTURAL FACILITY [AHH -1TeRT-UM1. (a) In this chapter, "recreational 13 or cultural facility" means an auditorium, civic center, 14 convention center, or exposition center. 15 Jbtl The commissioners court of a county [ortt i- a- pepesletiot� 16 o- 19,888 -og -fees] and the governing body of a municipality in that 17 county may jointly erect, 1$ acquire, equip, maintain, and operate a recreational or cultural 19 facility [an-atsditerttl. 20 Sec. 301.002. FINANCING OF RECREATIONAL OR CULTURAL FACILITY 21 LA B -TTeRfVM] . The recreational or cultural facility, ja ndsterstsm] 22 may be financed out of the general revenues of the county and the 23 municipality in proportions that the commissioners court of the 24 county and the governing body of the municipality decide are 76R5323 PAM -F 1 1 appropriate. 2 Sec. 301.003. DELEGATION OF AUTHORITY TO BOARD OF MANAGERS; 3 DONATIONS. (a) The commissioners court of the county and the 4 governing body of the municipality, by resolution or other proper 5 action; may delegate to a board of managers the authority to 6 acquire land for a recreational or cultural facility Can 7 auditaie+am] by purchase or Lease and to erect, maintain, and equip 8 a recreational or cultural facilit (an- aed +tergaz]. 9 (b) The board, for the benefit of the recreational or 10 cultural facility [anditerium], may accept gifts and bequests on 11 behalf of the county and municipality and may borrow, receive, 12 exchange, sell, and lend property. If a donor specifies a purpose 13 for a gift or loan, the board shall use the gift or loan for that 14 purpose. 15 Sec. 301.006. AUTHORITY OF BOARD TO CONTRACT. The board may 16 make any contract connected with or incidental to establishing, 17 equipping, maintaining, or operating the recreational or cultural. 18 facility [and +tee+ m] and may expend funds set aside by the county 19 and the municipality for purposes connected with operating and 20 maintaining the recreational or cultural facility (eetdtterxesnt]. 21 However, the board may not bind the county or the municipality to 22 make an expenditure of funds not specifically appropriated by the 23 county or the municipality for the benefit of the recreational. or 24 cultural facility Caudi-tee+ ] . 25 Sec. 301.007. FINANCIAL STATEMENT AND BUDGET. (a) Each 26 year the board shall prepare and present to the commissioners court 27 of the county and the governing body of the municipality a complete 7685323 PAM -F 2 /f a j 1 1 financial statement about the condition of the recreational or 2 cultural facility [attditerittm] and a proposed budget for the 3 anticipated financial needs of the recreational or cultural 4 facility [andi-ter +tam] for the next year. 5 (b) On the basis of the financial statement and budget, the 6 commissioners court of the county and the governing body of the 7 municipality may appropriate to the board an amount of money that 8 the commissioners court of the county and the governing body of the 9 municipality consider proper and necessary for the operation of the 10 recreational or cultural facility[attdtterttu�] . 11 Sec. 301.008. PERSONNEL. The board may employ a 12 superintendent or manager of the recreational or cultural facility 13 [adelztoritsm]. The superintendent or manager, with the consent of 14 the board, may employ permanent or temporary personnel that are 1s necessary for the maintenance and operation of the recreational or 16 cultural facility [auditerxttm] . 17 SECTION 3. This Act takes effect September 1, 1999. 18 SECTION 4. The importance of this legislation and the 19 crowded condition of the calendars in both houses create an 20 emergency and an imperative public necessity that the 21 constitutional rule requiring bills to be read on three several 22 days in each house be suspended, and this rule is hereby suspended. 76R5323 PAM -P 3 Ife's. t
