M7, 1 • ' • I ♦ I y t WHEREAS, in 1993, the Federal Government passed the Brady Handgun Violence Prevention Act (the "Act ") and charged local enforcement agencies with the responsibility for enforcement of the Act; and WHEREAS, in connection with enforcement of the Act, the City of Georgetown adopted Resolution No. 940412 -P, which established that a $10.00 fee be collected from firearm permitees to alleviate the financial impact imposed under the Act; WHEREAS, recent amendments to the Act have eliminated the need for local law enforcement agencies to perform criminal history checks on behalf of federal firearm licensees (i.e., gun dealers), thereby eliminating the need to collect this fee. NOW, THEREFORE, • • OF OF GEORGETOWN, SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following element(s) of the Century Plan: 1. Facilities & Services - Policy Plan Element 4.0, which states "The City provides for the safety of its citizens and supports the responsive delivery of coordinated services by the City and other public agencies "; and 2. Finance - Policy Plan Element 5.0, which states "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both short-term and long -term needs are provided "; and and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Resolution No. 940412 -P adopted by the City Council of the City of Georgetown on April 12, 1994 establishing a fee for execution of background checks pursuant to the Brady Handgun Violence Prevention Act is hereby repealed.
