AN ORDINANCE OF THE CITY COUNCIL ( "COUNCIL ") OF THE
CITY OF GEORGETOWN, TEXAS ( "CITY") AMENDING
CHAPTER 2.64 "BUILDING STANDARDS COMMISSION" OF
THE CODE OF ORDINANCES RELATING TO RULES AND
REGULATIONS; REPEALING CONFLICTING ORDINANCES
AND RESOLUTIONS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Building Standards Commission is a five member board established by
the City of Georgetown and codified in Chapter 2.64 of the Code of Ordinances; and
WHEREAS, Section 2.64.050 requires each case before the Commission be heard by a
majority of the member (at least three out of five); and
WHEREAS, currently there is a conflict between Section 2.64.050 discussed above and
Section 2.64.060 which states that a request not approved by an affirmative vote of four or more
members is considered denied; and
WHEREAS, the revision to Section 2.64.060 below is required to clarify that an
affirmative vote of all members of the Commission is required to approve a request, and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS THAT:
Section 1. The meeting at which this ordinance was approved was in all things
conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
Section 2. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim.
Section 3. Section 2.64.060 of the Code of Ordinances is amended as follows:
Sec. 2.64.060. Rules and regulations
The Commission shall keep minutes of its proceedings, showing the vote of each
member upon each question or, if absent or failing to vote, indicating such fact, and shall
keep records of its examinations and other official actions, all of which shall be filed in
the office of the Commission's recording secretary and shall be a public record. Any
request not approved by affirmative vote of three or more members shall be considered
denied. The Commission may adopt from time to time such additional rules and
regulations as it may deem necessary to carry into effect the provisions of this Chapter,
all of which rules and regulations shall operate uniformly in all cases.

Section 4. All ordinances that are in conflict with the provisions of this ordinance be and
the same are hereby repealed and all other ordinances of the City not in conflict with the provisions
of this ordinance shall remain in full force and effect.
Section 5. If any provision of this ordinance or application thereof to any person or
circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary
to attest. This Ordinance shall become effective in accordance with the provisions of the
Charter of the City of Georgetown.
