HomeMy WebLinkAboutORD 2014-35 - Airport Fuel SalesORDINANCE NO. c C� A -2)5— AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ADDING SECTION 12.32.230 "AIRPORT FUEL SALES" OF THE CODE OF ORDINANCES RELATING TO ADOPTION OF REGULATIONS GOVERNING AIRPORT FUEL SALES; PROVIDING A PENALTY CLAUSE; PROVIDING A SEVERABILITY CLAUSE; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown (the "City") currently sells fuel at the airport to both retail and wholesale customers; WHEREAS, the City has previously adopted safety standards governing fuels sales at the airport; WHEREAS, the City recognizes that in addition to safety standards, police and procedures governing the fuel sales are also required to protect the fiscal security of the Airport and administration of the sales; and NOW, THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. Section 12.23.230 "Airport Fuel Sales" as follows is hereby adopted: Sec. 12.23.230 Airport Fuel Sales The City Council authorizes the General Manager of Utilities to establish regulations, policies, and fees governing airport fuel sales. The General Manager of Utilities shall update City Council within one year following fuel policy changes. Section 4. All ordinances that are in conflict with the provisions of this ordinance be and the same are hereby repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or Ordinance Number: C3 Page 1 of 2 Description: Airport Fuel Sales Date Approved: , 2014 application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest.
