HomeMy WebLinkAboutRES 980113-R - Abandon Electric EsmtRESOLUTION NO. 70 1 °� ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED TO VACATE AND ABANDON A PRESCRIPTIVE ELECTRIC EASEMENT LOCATED ON A 9.5 -ACRE TRACT OF LAND LOCATED ADJACENT TO WILLIAMS DRIVE, PARK MEADOW BOULEVARD AND DAWN DRIVE, IN THE CITY OF GEORGETOWN, TEXAS, AND BEING OUT OF THE NICHOLAS PORTER SURVEY, ABSTRACT NO. 497, WILLIAMSON COUNTY, TEXAS. WHEREAS, the City of Georgetown has received an Application for the Vacation and Abandonment of a prescriptive electric easement shown as the shaded area on the attached Exhibit "A" and located on a 9.5 -acre tract of land adjacent to Williams Drive, Park Meadow Boulevard and Dawn Drive in the City of Georgetown, Texas; said 9.5 -acre tract being out of the Nicholas Porter Survey, Abstract No. 497, Williamson County, Texas, and being more fully described in a deed recorded in Volume 1143, Page 403 of the Deed Records of Williamson County, Texas, and; WHEREAS, upon considering the Application and additional information pertaining to the Application, the City Council now finds that the utilities previously located within said prescriptive easement have been relocated, thereby, eliminating the need for said easement; WHEREAS, the City Council directs the City Attorney to execute and file a Quitclaim Deed abandoning said prescriptive easement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council finds that this action implements the following policies of the Century Plan - Policy Plan: 1. Growth and Physical Development Policy 1, which states "The City will ensure that future land use patterns provide economic, cultural, and social N. WPD activities to all residents, businesses and organizations; and the City's development process encourages new and infill development; and 2. Utilities/Energy Policy 2, which states "The City will establish Utility policies which take into consideration the needs of all citizens of the community and take necessary precautions to prevent harmful ecological impact on the environment." The City Council has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Mayor is hereby authorized to execute, on behalf of the City of Georgetown, a Quitclaim Deed abandoning a prescriptive electric easement shown as the shaded area on the attached Exhibit "A" and located on a 9.5 -acre tract of land adjacent to Williams Drive, Park Meadow Boulevard and Dawn Drive in the City of Georgetown, Texas; said 9.5 -acre tract being out of the Nicholas Porter Survey, Abstract No. 497, Williamson County, Texas, and being more fully described in a deed recorded in Volume 1143, Page 403 of the Deed Records of Williamson County, Texas.
