HomeMy WebLinkAboutRES 980714-Q - Abandon 425 Oak Crest LnRESOLUTION NO. 9071 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A QUIT CLAIM DEED TO VACATE AND ABANDON A PLATTED TEN (10) FOOT AND DEEDED TWENTY (20) FOOT PUBLIC UTILITY EASEMENT, CENTERED ON THE PROPERTY LINE FOR OAK CREST ESTATES, UNIT I, BLOCK 1, LOTS 17 AND 18 AS RECORDED IN THE PLAT RECORDS OF CABINET B, SLIDE 79 AND VOLUME 527, PAGE 155 OF THE DEED RECORDS OF WILLIAMSON COUNTY, TEXAS, AND LOCATED AT 425 OAK CREST LANE. WHEREAS, the City of Georgetown has received an Application for the Vacation of a platted ten (10 ) foot and deeded twenty (20) foot wide Public Utility Easement centered on the property line for Oak Crest Estates, Unit I, Block 1, Lots 17 and 18, as recorded in Cabinet B, Slides 79 of the Plat Records and Volume 527, Page 155 of the Deed Records of Williamson County, Texas, and located at 425 Oak Crest Lane; and WHEREAS, upon considering the Application and additional information pertaining to the Application, the City Council now finds that there are no utilities existing in the easement or that portion requested abandoned and that the utility companies serving the area including and surrounding the easement have determined that there exists no present or foreseeable need for the easement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council finds that this action implements the following policies of the Century Plan - Policy Plan: 1. Growth and Physical Development Policy 1, which states "The City will ensure that future land use patterns provide economic, cultural, and social activities to all residents, businesses and organizations; and the City's development process encourages new and infill development; and 2. Utilities/Energy Policy 2, which states "The City will establish Utility policies which take into consideration the needs of all citizens of the community and Oak Crest Estates, Unit I, Block 1, Lots 17 & 18 Abandonment Resolution No. l ofy 71 `7 Page 1 of 2 Z:\CUR PLAN\CITYCNCL\ABAND\OAK-CI.RFS take necessary precautions to prevent harmful ecological impact on the environment." The City Council has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Mayor is hereby authorized to execute, on behalf of the City of Georgetown, a Quit Claim Deed abandoning a platted ten (10) foot and deeded twenty (20) foot wide Public Utility Easement centered on the property line for Oak Crest Estates, Unit I, Block 1, Lots 17 and 18, as recorded in Cabinet B, Slides 79 of the Plat Records and Volume 527, Page 155 of the Deed Records of Williamson County, Texas, and located at 425 Oak Crest Lane, and the City Secretary to attest thereto on behalf of the City of Georgetown.
