HomeMy WebLinkAboutRES 980922-U - ANX IH35 & Westinghouse RdRESOLUTION NO. ��'O9aa" lZ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, GRANTING A PETITION FOR ANNEXATION AND ADOPTING PROPOSED SERVICE PLANS FOR THE EXTENSION OF THECITY BOUNDARY TO INCLUDE: 0.80 OF AN ACRE OF LAND IN THE EPHRAIM EVANS SURVEY, ABSTRACT NO. 212, AS DESCRIBED IN EXHIBIT A OF THIS RESOLUTION WHEREAS, as a Home -Rule Municipality, according to Chapter 43 of the Texas Local Government Code, the City of Georgetown has the authority to fix and extend its municipal boundaries and annex area adjacent to its boundaries; and WHEREAS, a municipality may annex only in its extraterritorial jurisdiction, unless the municipality owns the area; and WHEREAS, State law gives authority to municipalities to annex sparsely occupied areas on the petition of the area landowners when the area is one-half mile or less in width, contiguous to tle municipality, and is vacant and without residents or on which fewer than three qualified voters reside; and WHEREAS, a written petition for annexation has been received from the owners of the 0.80 OF AN ACRE OF LAND IN THE EPHRAIM EVANS SURVEY, ABSTRACT NO. 212, describing the area by metes and bounds; and WHEREAS, this property is one-half mile or less in width, is contiguous to the City limits of the City of Georgetown, and is vacant and without residents or has fewer than three qualified votes residing on it; and WHEREAS, the City Council of the City of Georgetown, Texas heard the petition and the arguments for and against the annexation; and WHEREAS, a proposed service plan was presented to and discussed by the Council and all interested persons; and WHEREAS, the City Council has determined that the annexation is in the best interests of the City of Georgetown; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element: 1. Environmental and Resource Conservation Policy 1, which states: "The Physical attributes that make Georgetown attractive are protected"; and 0.80 of an acre in the Ephraim Evans Survey, Abstract No. 212 Resolution No. q,o 9asZ ` Page 1 of 2 2. Growth and Physical Development Policy 1, which states: "Land use patterrs within the City provide economic, cultural, and social activities to all residents, businesses and organizations"; and 3. Growth and Physical Development Policy 2, which states: "The City's regulations implement the policy statements and provide the opportunity to seek change with reasonable effort and expense"; and 4. Growth and Physical Development Policy 3, which states: "Annexations procedures and standards benefit the community"; and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Poicy Plan. SECTION 2. The City Council of the City of Georgetown hereby grants the petition for voluntary annexation of 0.80 of an acre of land in the Ephraim Evans Survey, Abstract No. 212, located at the southeast corner of IH35 and Westinghouse Road, as described in Exhibit A. SECTION 3. The Mayor is hereby authorized to sign on behalf of the City Council of the City of Georgetown. SECTION 4. This resolution shall be effective immediately upon adoption.
